Local Government Members (2016/17) (Canterbury Regional Council) Amendment Determination (No 2) 2017: expired, on the close of 30 June 2017, pursuant to clause 3 of the Local Government Members (2016/17) (Canterbury Regional Council) Determination 2016 (LI 2016/159).

Pursuant to clauses 6 and 7A of Schedule 7 of the Local Government Act 2002 and to the Remuneration Authority Act 1977, the Remuneration Authority makes the following determination (to which is appended an explanatory memorandum).

Determination

1 Title

This determination is the Local Government Members (2016/17) (Canterbury Regional Council) Amendment Determination (No 2) 2017.

2 Commencement

(1)

Clauses 4, 5, and 6 are deemed to have come into force on 18 October 2016.

(2)

Clause 7 is deemed to have come into force on 17 November 2016.

(3)

The rest of this determination comes into force on the day after the date of its notification in the Gazette.

3 Principal determination

This determination amends the Local Government Members (2016/17) (Canterbury Regional Council) Determination 2016 (the principal determination).

4 Clause 2 amended (Commencement)

In clause 2, replace “the day after the date on which the official result of the 2016 triennial general election of members of the Canterbury Regional Council is declared” with “18 October 2016”.

5 New clause 3A inserted (Application)

After clause 3, insert:

3A Application

This determination applies to—

(a)

appointed members of the Canterbury Regional Council from 18 October 2016; and

(b)

elected members of the Canterbury Regional Council from 19 October 2016.

6 New clause 10A inserted (Travel time allowance)

After clause 10, insert:

10A Travel time allowance

(1)

The Canterbury Regional Council may pay a member a travel time allowance if the office of the member cannot be properly regarded as a full-time position.

(2)

An allowance may be paid to a member under subclause (1) for each day within the period of this determination that—

(a)

the member is travelling—

(i)

on the Council’s business; and

(ii)

by the quickest form of transport that is reasonable in the circumstances; and

(b)

the travel time of the member exceeds 1 hour.

(3)

The allowance is payable, in relation to each day for which the member qualifies under subclause (2),—

(a)

at $37.50 per hour; but

(b)

only in respect of the travel time for that day that exceeds 1 hour.

(4)

In this clause, on the Council’s business includes travel between a member’s residence and an office of the Canterbury Regional Council.

7 Schedule amended

In the Schedule, item relating to “Chairperson, Regional Hearing Committee”, replace “Regional” with “Regulation”.

Explanatory memorandum

This memorandum is not part of the determination, but is intended to indicate its general effect.

This determination amends the Local Government Members (2016/17) (Canterbury Regional Council) Determination 2016 (the principal determination), by—

  • amending the commencement date of the principal determination to an earlier date and inserting an application clause to reflect the fact that—

    • appointed members of the Canterbury Regional Council came into office on 18 October 2016 (being the date on which they were appointed); and

    • elected members came into office on 19 October 2016 (being the day after the date on which the official result of the 2016 triennial general election of members was declared by public notice); and

  • inserting a provision that provides for travel time allowances to be paid to certain members in certain circumstances; and

  • amending the Schedule of the principal determination to reflect the correct title of the Chairperson, Regulation Hearing Committee.
