Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2008 Amendment Notice 2017

Pursuant to regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister for Primary Industries gives the following notice.

1 Title

This notice is the Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2008 Amendment Notice 2017.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Principal notice

This notice amends the Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2008 (Gazette 2008, p 2214) (the principal notice).

4 Clause 5 replaced (Confirmation of tangata whenua)

Replace clause 5 with:

5. Confirmation of tangata whenua—Ngāi Tūmapuhiārangi, together with Ngāti Hāmua, as represented by the Ngāi Tumapuhia a Rangi Māori Marae Committee, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki relates.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, amends the Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2008 (Gazette 2008, p 2214) (the principal notice). The amendment has been made at the request of the tangata whenua for the relevant area/rohe moana.

The amendment replaces clause 5 of the principal notice to, among other things, update the name of the marae committee that represents the tangata whenua. The amendment is not intended to confirm a new group as tangata whenua of the area/rohe moana.
