These regulations are made under section 303 of the Education Act 1989 and section 13 of the Interpretation Act 1999 on the advice and with the consent of the Executive Council.


1 Title

These regulations are the Student Allowances (Increase for 2018) Amendment Regulations 2017.

2 Commencement


These regulations come into force on 1 January 2018.


However, regulation 5(1) is deemed to have come into force on 1 April 2017 immediately after the commencement of the Student Allowances Amendment Regulations 2017.

3 Principal regulations

These regulations amend the Student Allowances Regulations 1998 (the principal regulations).

4 Schedule 1 amended

In Schedule 1, after Part 1, insert the Part 2 set out in Schedule 1 of these regulations.

5 Schedule 2 amended


In Schedule 2, clause 2(1) table, item 1(b), replace “126.69” with “127.74”.


In each provision of Schedule 2 of the principal regulations listed in the first column of Schedule 2 of these regulations, replace the amount set out opposite that provision in the second column with the amount set out opposite that provision in the third column.

Part 2 Provision relating to Student Allowances (Increase for 2018) Amendment Regulations 2017

2 Amendments apply to courses of study commencing before, on, or after 1 January 2018


This clause applies to the rates in Schedule 2 as amended by regulation 5(2) of the Student Allowances (Increase for 2018) Amendment Regulations 2017.


Those rates must be used for any payment on or after 1 January 2018 of an allowance—


continued by regulation 3(a) (basic grant) or regulation 3(b) (independent circumstances grant); and


granted in respect of a course of study commencing before, on, or after 1 January 2018.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, most of which come into force on 1 January 2018, amend Schedule 2 of the Student Allowances Regulations 1998.

Regulation 5(1) corrects an error in a rate in the mandatory annual general adjustment effective on 1 April 2017. The error is that the rate was adjusted to $126.69. In that adjustment, the rate should instead have been adjusted to a higher amount (actually used in operational practice on and after 1 April 2017), namely $127.74.

The other amendments adjust the rates of basic grants and independent circumstances grants so as to achieve a $50 net increase for students on an M tax code. Two of the rates (in the clause 1(1) table, items 1(a) and 1(b)) are adjusted to achieve a $100 net increase because those rates are designed to reflect the living costs of 2 adults and their calculation involves doubling the equivalent rate for an individual.
