These regulations are made under section 303 of the Education Act 1989 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Student Allowances Amendment Regulations 2018.

2 Commencement

(1)

By virtue of section 303(3E) of the Education Act 1989, these regulations come into force on 1 April 2018.

(2)

However, regulation 5 and the cross-heading above regulation 5 come into force on 1 July 2018.

3 Principal regulations

These regulations amend the Student Allowances Regulations 1998 (the principal regulations).

Amendments on 1 April 2018

4 Schedule 2 amended

In each provision of Schedule 2 of the principal regulations listed in the first column of the Schedule of these regulations, replace the amount set out opposite that provision in the second column with the amount set out opposite that provision in the third column.

Amendments on 1 July 2018

5 Regulation 2 amended (Interpretation)

(1)

In regulation 2(1), definition of personal income, replace paragraph (d) with:

(d)

does not include any amount received by way of any tax credit under—

(i)

subparts MA to MG of the Income Tax Act 2007; or

(ii)

subpart MZ of the Income Tax Act 2007; and

(2)

In regulation 2(1), definition of spousal or partner’s income, replace paragraph (d) with:

(d)

does not include any amount received by way of any tax credit under—

(i)

subparts MA to MG of the Income Tax Act 2007; or

(ii)

subpart MZ of the Income Tax Act 2007; and

Revocation

6 Revocation

The Student Allowances Amendment Regulations 2017 (LI 2017/34) are revoked.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Student Allowances Regulations 1998.

The amendments—

  • increase, on 1 April 2018, the rates of the basic grants and independent circumstances grants, and the income thresholds, to reflect a 1.36% increase in the New Zealand Consumers Price Index from the December 2016 quarter to the December 2017 quarter (calculated for all quarters using the New Zealand Consumers Price Index (All Groups), excluding cigarettes and other tobacco products):

  • amend, on 1 July 2018, the definitions of personal income and spousal or partner’s income to exclude as income all family scheme tax credits, including the Best Start tax credit (introduced on 1 July 2018 by the Families Package (Income Tax and Benefits) Act 2017).
