Fisheries (Declaration of Te Rae o Kohi Mātaitai Reserve) Notice 2018

Pursuant to regulation 23 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries gives the following notice after complying with regulations 19 to 23 of those regulations.

1 Title

This notice is the Fisheries (Declaration of Te Rae o Kohi Mātaitai Reserve) Notice 2018.

2 Commencement

This notice comes into force on the 28th day after the date of its notification in the Gazette.

3 Declaration of mātaitai reserve

(1)

This notice declares that the area of New Zealand fisheries waters (except South Island fisheries waters) within the following lines is a mātaitai reserve:

(a)

from the starting point at 37°53.830′S and 176°49.900′E (north-west of Thornton); then

(b)

by a straight line in a northerly direction to 37°53.660′S and 176°49.900′E (200 metres north of the mean high-water mark); then

(c)

by a line in a generally south-easterly direction, always 200 metres from the mean high-water mark, to 37°56.492′S and 177°00.353′E (offshore); then

(d)

by a line in a generally north-easterly then south-easterly direction, always 463 metres from the mean high-water mark that starts from point F, to 37°57.996′S and 177°03.700′E (offshore); then

(e)

by a straight line in a southerly direction to 37°58.288′S and 177°03.700′E (on the eastern side of the Maraetotara Stream mouth); then

(f)

by a line in a generally north-westerly direction along the mean high-water mark to 37°56.595′S and 177°00.657′E (point F, on the eastern side of the Whakatane River mouth); then

(g)

by a straight line in a westerly direction to 37°56.639′S and 177°00.445′E (on the western side of the Whakatane River mouth); then

(h)

by a line in a generally north-westerly direction along the mean high-water mark to the starting point.

The mātaitai reserve is to be known as Te Rae o Kohi Mātaitai Reserve.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on the 28th day after the date of its notification in the Gazette.

The notice declares Te Rae o Kohi Mātaitai Reserve, which is over a coastal strip between Wahieroa (near the Rangitaiki River) and the Maraetotara Stream (at Ohope). The tangata whenua of the area that includes the mātaitai reserve are represented by Te Rūnanga o Ngāti Awa.

A mātaitai reserve is a traditional fishing ground for which Tāngata Kaitiaki/Tiaki are appointed under the regulations.
