Animal Welfare (Care and Procedures) Amendment Regulations 2018

These regulations are made under section 183A(1) of the Animal Welfare Act 1999

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister of Agriculture made after complying with sections 183A(10) and 184 of that Act.

Regulations

1 Title

These regulations are the Animal Welfare (Care and Procedures) Amendment Regulations 2018.

2 Commencement

These regulations come into force on 1 October 2018.

3 Principal regulations

These regulations amend the Animal Welfare (Care and Procedures) Regulations 2018 (the principal regulations).

4 Regulation 3 amended (Interpretation)

In regulation 3, insert in its appropriate alphabetical order:

stall

(a)

means an enclosure in which a pig is kept individually and that prevents the pig from turning around; but

(b)

does not include a farrowing crate

5 Regulation 24 amended (Pigs must have access to shelter and dry lying area)

In regulation 24(1)(b), after “farrowing crate”, insert “or a stall”.

6 Regulation 27 amended (Use of mating stalls)

(1)

Replace the heading to regulation 27 with Prohibition of stalls other than for mating.

(2)

In regulation 27(1) and (2), replace “mating stall” with “stall”.

7 Schedule 2 amended

(1)

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, item relating to Minimum Standard No. 5(a) and (b), new paragraph (b), after “farrowing crates”, insert “or stalls”.

(2)

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, item relating to Minimum Standard No. 6(ca) to (cc), new paragraph (cb), after “farrowing crates”, insert “or stalls”.

(3)

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, replace the item relating to Minimum Standard No. 11(a) with:

Replace Minimum Standard No. 11(a) with:

(a)

Pigs must not be confined to stalls unless—

(i)

the confinement is for the purpose of mating; and

(ii)

the confinement is for no more than 7 days per reproductive cycle; and

(iii)

the pigs are released from the stalls as soon as practicable after mating.

(4)

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, after the item relating to Minimum Standard No. 11(a), insert:

Where sows and gilts are group housed, they must be managed to minimise the effects of aggression.

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, replace the item relating to Minimum Standard No. 11(c) with:

Replace Minimum Standard No. 11(c) and (d) with:

Where sows and gilts are housed in stalls for the purpose of mating, they must be able to stand in their natural stance without contact with any side of the stall and be able to lie comfortably on their sides without disturbing neighbouring sows or gilts.

(d)

Sows and gilts that are in stalls for the purpose of mating must have a dry, smooth, non-slip sleeping area.

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, replace the item relating to Minimum Standard No. 11(f) with:

(f)

If individually confined in a pen, sows and gilts must have sufficient space so that they can stand up, turn around without touching the walls, and lie comfortably in a natural position, and must be provided with separate dunging, lying and eating areas.

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, item relating to Appendix II, after the new definition of pain relief, insert:

stallAn enclosure in which a pig is kept individually and that prevents the pig from turning around, but does not include a farrowing crate.

In Schedule 2, Part 2, item relating to the Animal Welfare (Pigs) Code of Welfare 2010, after the first item relating to Appendix II, insert:

In Appendix II, revoke the definitions of dry sow stall, mated gilt, and mating stall.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2018, amend the Animal Welfare (Care and Procedures) Regulations 2018. The amendments clarify that pigs must not be confined to stalls except for the purpose of mating.
