Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Te Hika o Papauma) Notice 2018

Pursuant to regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries, after compliance with the requirements of those provisions, gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Te Hika o Papauma) Notice 2018.

2 Commencement

This notice comes into force on the day after the date of its notification in the Gazette.

3 Customary food gathering area/rohe moana

This notice applies to the customary food gathering area/rohe moana defined by clause 3(c) of the Fisheries (Kaimoana Customary Fishing) Notice (No. 12) 2003 (Gazette 2003, p 1129), which is an area between the Owahanga and Whareama Rivers on the Wairarapa coast.

4 Tangata whenua

The tangata whenua of the area/rohe moana is Te Hika o Papauma.

5 Appointment cancelled

(1)

The Minister of Fisheries has cancelled the appointment of Matai Hamuera Broughton as a Tangata Kaitiaki/Tiaki for the area/rohe moana.

(2)

The cancellation takes effect on the date on which this notice comes into force.

6 New appointments

(1)

The Minister of Fisheries has appointed Rosemary Jane Byl in accordance with regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 as Tangata Kaitiaki/Tiaki for the area/rohe moana.

(2)

The Minister of Fisheries has appointed William Joseph Broughton in accordance with regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 as Tangata Kaitiaki/Tiaki for the area/rohe moana.

(3)

Each of the appointments took effect on 12 September 2018.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is given under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on the day after the date of its notification in the Gazette.

The notice relates to a customary food gathering area/rohe moana of the tangata whenua represented by Te Hika o Papauma. The area/rohe moana is an area between the Owahanga and Whareama rivers on the Wairarapa coast, defined in the Fisheries (Kaimoana Customary Fishing) Notice (No. 12) 2003 (Gazette 2003, p 1129).

Notice is given of the cancellation of the appointment of Matai Hamuera Broughton as a Tangata Kaitiaki/Tiaki for the area/rohe moana and the appointment of Rosemary Jane Byl as a replacement. Notice is also given of a new appointment of William Joseph Broughton as a Tangata Kaitiaki/Tiaki for the area/rohe moana. The Minister of Fisheries made the cancellation and appointments at the request of Te Hika o Papauma.

The powers of Tāngata Kaitiaki/Tiaki are set out in the regulations.
