Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Te Tai Hauāuru) Notice 2019

Pursuant to regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Kaitiaki/Tiaki for Area/Rohe Moana of Te Tai Hauāuru) Notice 2019.

2 Commencement

This notice comes into force on 16 August 2019.

3 Customary food gathering area/rohe moana

This notice applies to the customary food gathering area/rohe moana in the New Zealand fisheries waters (except South Island fisheries waters) within the following lines:

(a)

from an offshore starting point 8 nautical miles seawards of the outer limits of the territorial sea (12 nautical mile limit) boundary at approximately 39°32.526′S and 173°23.430′E; then

(b)

by a line of which every point is 8 nautical miles seawards of the outer limits of the territorial sea (12 nautical mile limit) boundary in a generally south-easterly then southerly direction to an offshore point at approximately 40°34.782′S and 174°37.166′E; then

(c)

by a line in a generally south-easterly direction to the outer limits of the territorial sea (12 nautical mile limit) boundary at approximately 40°40.533′S and 174°44.506′E; then

(d)

by a line in a south-westerly direction following the outer limits of the territorial sea (12 nautical mile limit) to an offshore point where the outer limits of the territorial sea meet the outer boundary of the South Island fisheries waters at approximately 40°46.002′S and 174°38.838′E; then

(e)

by a line in a generally north-easterly direction following the outer boundary of the South Island fisheries waters to an offshore point at 40°42.000′S and 174°40.000′E; then

(f)

by a line in a generally north-westerly direction along the South Island fisheries waters outer boundary to an offshore point at approximately 40°06.355′S and 173°10.889′E; then

(g)

by a line in a generally north-easterly direction to the point of commencement.

4 Tangata whenua

This notice is made under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on 16 August 2019.

The notice relates to a customary food gathering area/rohe moana of the tangata whenua represented by Te Rūnanga o Ngāti Tama, Te Rūnanga o Ngāti Mutunga, Ngāti Maru (Taranaki) Fisheries Trust, Te Kotahitanga o Te Atiawa Trust, Te Rūnanga o Ngāti Ruanui, Ngā Hapū o Ngāruahine Trust, Te Kāhui o Taranaki Trust, Te Kaahui o Rauru, Ngā Tāngata Tiaki o Whanganui, Te Rūnanga o Ngā Wairiki, Te Patiki Holdings Ltd representing Ngāti Hauiti, Te Ohu Tiaki o Rangitāne te Ika a Māui, Muaūpoko Tribal Authority, Atiawa ki Whakarongotai Charitable Trust, Raukawa ki te Tonga Trust, Te Rūnanga o Toa Rangatira Inc, and Te Atiawa Poneke. The area/rohe moana is an area of the Taranaki Bight beginning approximately 20 nautical miles offshore and extending south to the boundary with the South Island fisheries waters.

Notice is given of the appointment of 29 Tāngata Kaitiaki/Tiaki for the area/rohe moana. The Minister of Fisheries made the appointments at the request of Te Rūnanga o Ngāti Tama, Te Rūnanga o Ngāti Mutunga, Ngāti Maru (Taranaki) Fisheries Trust, Te Kotahitanga o Te Atiawa Trust, Te Rūnanga o Ngāti Ruanui, Ngā Hapū o Ngāruahine Trust, Te Kāhui o Taranaki Trust, Te Kaahui o Rauru, Ngā Tāngata Tiaki o Whanganui, Te Rūnanga o Ngā Wairiki, Te Patiki Holdings Ltd representing Ngāti Hauiti, Te Ohu Tiaki o Rangitāne te Ika a Māui, Muaūpoko Tribal Authority, Atiawa ki Whakarongotai Charitable Trust, Raukawa ki te Tonga Trust, Te Rūnanga o Toa Rangatira Inc, and Te Atiawa Poneke.
