Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Amendment Notice (No 2) 2019

Pursuant to sections 13, 20, and 75 of the Fisheries Act 1996, the Minister of Fisheries gives the following notice after complying with sections 11, 12, 13, 21, and 75A of that Act.

Notice

1 Title

This notice is the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Amendment Notice (No 2) 2019.

2 Commencement

This notice comes into force on 30 September 2019.

3 Application

This notice applies on and from the first day of the fishing year starting on 1 October 2019.

5 Schedule 1 amended

In Schedule 1, replace each item relating to a fishstock code specified in column 1 of Schedule 1 of this notice with the corresponding item in that schedule.

6 Schedule 2 amended

(1)

In Schedule 2, replace the item relating to BNS7 and BNS10 with the items set out in Schedule 2 of this notice.

(2)

In Schedule 2, after the item relating to JMA1, insert the item set out in Schedule 3 of this notice.

(3)

In Schedule 2, item relating to SWA1 and SWA4, delete “, SWA4”.

(4)

In Schedule 2, replace the item relating to SWA3 with the item set out in Schedule 4 of this notice.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015. The amendments commence on 30 September 2019 but apply on and from the first day of the fishing year starting on 1 October 2019.

The amendments set or vary 1 or more of the following things for quota management stocks with certain fishstock codes:

  • the total allowable catch (TAC):

  • the total allowable commercial catch (TACC):

  • the interim deemed value rate (interim DVR):

  • the basic annual deemed value rate (basic annual DVR):

  • the different rates that apply to each level by which a commercial fisher’s reported catch exceeds the fisher’s annual catch entitlement (differential DVR).

The things set or varied by this notice are set out below. Anything not mentioned below is unchanged. Values specified in the principal notice may be overridden by various means. Where an original value is cited, that value is taken from the principal notice and ignores any change made without amendment to that notice.

The things set or varied are—

Bluenose

  • for BNS7, interim DVR increases from $2.70/kg to $3.60/kg, basic annual DVR increases from $3.00/kg to $4.00/kg, and differential DVR changes to the special rates set out in Schedule 2 of this notice:

Cardinal fish

  • for CDL5, interim DVR increases from $0.26/kg to $0.27/kg and basic annual DVR reduces from $0.52/kg to $0.30/kg:

Elephant fish

  • for ELE7, TAC is set at 127 greenweight tonnes and TACC increases from 90 to 102 greenweight tonnes:

Red gurnard

  • for GUR7, TAC increases from 1 065 to 1 176 greenweight tonnes and TACC increases from 975 to 1 073 greenweight tonnes:

Hake

  • for HAK7, TAC reduces from 5 120 to 2 300 greenweight tonnes and TACC reduces from 5 064 to 2 272 greenweight tonnes:

Hoki

  • for HOK1, TAC reduces from 151 540 to 116 190 greenweight tonnes and TACC reduces from 150 000 to 115 000 greenweight tonnes:

John dory

  • for JDO7, TAC increases from 226 to 247 greenweight tonnes and TACC increases from 209 to 230 greenweight tonnes:

Jack mackerel

  • for JMA7, interim DVR increases from $0.14/kg to $0.18/kg, basic annual DVR increases from $0.15/kg to $0.20/kg, and differential DVR changes from standard to special at the rates set out in Schedule 3 of this notice:

Kingfish

  • for KIN3, interim DVR reduces from $8.00/kg to $4.00/kg and basic annual DVR reduces from $8.90/kg to $4.45/kg:

Ling

  • for LIN7, TAC increases from 3 144 to 3 458 greenweight tonnes and TACC increases from 3 080 to 3 387 greenweight tonnes:

Orange roughy

  • for ORH3B, TAC increases from 6 413 to 7 116 greenweight tonnes and TACC increases from 6 091 to 6 772 greenweight tonnes:

  • for ORH7A, TAC increases from 1 680 to 2 163 greenweight tonnes and TACC increases from 1 600 to 2 058 greenweight tonnes:

Paua

Tarakihi

  • for TAR1, TAC reduces from 1 390 to 1 333 greenweight tonnes and TACC reduces from 1 097 to 1 045 greenweight tonnes:

  • for TAR2, TAC reduces from 1 823 to 1 658 greenweight tonnes and TACC reduces from 1 500 to 1 350 greenweight tonnes:

  • for TAR3, TAC reduces from 1 174 to 1 060 greenweight tonnes and TACC reduces from 1 040 to 936 greenweight tonnes:

  • for TAR7, TAC reduces from 1 174 to 1 154 greenweight tonnes and TACC reduces from 1 042 to 1 024 greenweight tonnes.
