Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Areas/Rohe Moana of Te Rūnanga o Ngāti Waewae) Notice 2019

Pursuant to regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Tāngata Tiaki/Kaitiaki for Areas/Rohe Moana of Te Rūnanga o Ngāti Waewae) Notice 2019.

2 Commencement

This notice comes into force on 27 November 2019.

3 Revocation of this notice

This notice is revoked at the end of 13 August 2024.

4 Customary food gathering areas/rohe moana

This notice applies to the customary food gathering areas/rohe moana defined by—

(a)

clause 2(c) of the Fisheries (South Island Customary Fishing) Notice (No. 8) 2009 (Gazette 2009, p 2723), which is an area from the north bank of the Pouerua River to the Hokitika River:

clause 2(c) of the Fisheries (South Island Customary Fishing) Notice (No. 10) 2009 (Gazette 2009, p 2724), which is an area from the Hokitika River to the Kawatiri/Buller River:

(c)

clause 2(c) of the Fisheries (South Island Customary Fishing) Notice (No. 2) 2010 (Gazette 2010, p 304), which is an area from the Kawatiri/Buller River to Kahurangi Point.

5 Appointments cancelled

(1)

The Minister of Fisheries has cancelled the appointment of Kori Hutana as a Tangata Tiaki/Kaitiaki for the area/rohe moana described by clause 4(a).

(2)

The cancellation took effect at the end of 11 July 2019.

(3)

The Minister of Fisheries has cancelled the appointment of Francois Tumahai as a Tangata Tiaki/Kaitiaki for the areas/rohe moana described by clause 4(b) and (c).

(4)

The cancellation took effect at the end of 13 August 2019.

6 New appointments

(1)

The Minister of Fisheries has appointed Hamiria Hutana as a Tangata Tiaki/Kaitiaki for the area/rohe moana described by clause 4(a).

(2)

The appointment—

(a)

took effect on 12 July 2019; and

(b)

expires at the end of 11 July 2024.

(3)

The Minister of Fisheries has appointed the following people as Tāngata Tiaki/Kaitiaki:

(a)

Mahana Coulston, for the area/rohe moana described by clause 4(b):

(b)

Ned Tauwhare, for the area/rohe moana described by clause 4(c).

(4)

The appointments—

(a)

took effect on 14 August 2019; and

(b)

expire at the end of 13 August 2024.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is given under the Fisheries (South Island Customary Fishing) Regulations 1999 (the regulations). It comes into force on 27 November 2019 and revokes itself at the end of 13 August 2024.

The notice relates to 3 customary food gathering areas/rohe moana of the tangata whenua represented by Te Rūnanga o Ngāti Waewae on the West Coast of the South Island. The 3 areas/rohe moana are—

  • an area from the north bank of the Pouerua River to the Hokitika River; and

  • an area from the Hokitika River to the Kawatiri/Buller River; and

  • an area from the Kawatiri/Buller River to Kahurangi Point.

Notice is given of the cancellation of the appointment of a tangata tiaki/kaitiaki, and the appointment of a replacement, for each area/rohe moana. The Minister of Fisheries cancelled the appointments and made the replacement appointments at the request of Te Rūnanga o Ngāti Waewae.

The powers of Tāngata Tiaki/Kaitiaki are set out in the regulations.
