Fisheries (Notification of Kaitukutohu (Tāngata Kaitiaki/Tiaki) for Area/Rohe Moana of Te Whānau Moana and Te Rorohuri) Notice 2019

Pursuant to regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries gives the following notice.

Notice

1 Title

This notice is the Fisheries (Notification of Kaitukutohu (Tāngata Kaitiaki/Tiaki) for Area/Rohe Moana of Te Whānau Moana and Te Rorohuri) Notice 2019.

2 Commencement

This notice comes into force on 31 January 2020.

3 Customary food gathering area/rohe moana

This notice applies to a customary food gathering area/rohe moana in the New Zealand fisheries waters (except South Island fisheries waters) within the following lines:

(a)

from the starting point at 34°50.780′S and 173°15.959′E; then

(b)

by a straight line to a point at 34°57.867′S and 173°19.248′E; then

(c)

by a straight line to intersect the west coast of the Karikari Peninsula at a point at 34°57.492′S and 173°20.392′E; then

(d)

by a straight line to a point on the east coast of the Karikari Peninsula at 34°56.602′S and 173°23.043′E; then

(e)

by a straight line to a point at 34°56.189′S and 173°24.281′E; then

(f)

by a straight line proceeding in a generally north-east direction to intersect with the outer exclusive economic zone boundary at approximately 32°20.995′S and 176°29.733′E; then

(g)

following the exclusive economic zone boundary to a point at approximately 30°55.169′S and 173°15.336′E; then

(h)

by a straight line in a generally southerly direction back to the starting point.

4 Tangata whenua

(1)

The tangata whenua of the area/rohe moana are Te Whānau Moana and Te Rorohuri.

(2)

The tangata whenua of the area/rohe moana have notified a local dialect word, Kaitukutohu, as being equivalent to Tangata Kaitiaki/Tiaki.

5 Appointments

(1)

The Minister of Fisheries has appointed the following people as Kaitukutohu (Tāngata Kaitiaki/Tiaki) for the area/rohe moana:

(2)

The appointments took effect on 29 October 2019.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice is made under the Fisheries (Kaimoana Customary Fishing) Regulations 1998 (the regulations). It comes into force on 31 January 2020.

The notice relates to a customary food gathering area/rohe moana of the tangata whenua represented by Te Whānau Moana and Te Rorohuri. The area/rohe moana is in Northland, around the Karikari Peninsula north of a line between Taha, Paamu, Tuu, and Kaha, including the eastern side of Rangaunu Harbour and the northern part of Doubtless Bay. The proposed area extends seaward to the limit of New Zealand fisheries, being the 200-nautical-mile limit.

Notice is given of the appointment of 3 Kaitukutohu (Tāngata Kaitiaki/Tiaki) for the area/rohe moana. The Minister of Fisheries made the appointments at the request of Te Whānau Moana and Te Rorohuri (Haiti-Tai-Marangai Marae).

The powers of Tāngata Kaitiaki/Tiaki are set out in the regulations.
