This order is made under section 67B of the Fisheries Act 1996

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister of Fisheries made after complying with section 67B(3) of that Act.

Order

1 Title

This order is the Fisheries (Schedule 5A—Rock Lobster) Order 2020.

2 Commencement

(1)

This order comes into force on 1 April 2020.

(2)

However, clause 4 comes into force on 1 April 2021.

3 Schedule 5A of Fisheries Act 1996 amended on 1 April 2020

In Schedule 5A of the Fisheries Act 1996, repeal the items relating to CRA1, CRA2, CRA3, CRA4, CRA5, CRA6, CRA7, CRA8, CRA9, and CRA10.

4 Schedule 5A of Fisheries Act 1996 amended on 1 April 2021

In Schedule 5A of the Fisheries Act 1996, insert in their appropriate alphabetical order:

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order amends Schedule 5A of the Fisheries Act 1996. Schedule 5A lists stocks for which annual catch entitlements cannot be carried forward under section 67A of that Act.

This order removes rock lobster stocks from Schedule 5A for the fishing year that runs from 1 April 2020 to 31 March 2021. The order reinstates those stocks in the schedule at the start of the next fishing year.
