Road User Charges Amendment Regulations 2020

These regulations are made under section 89 of the Road User Charges Act 2012 on the advice and with the consent of the Executive Council.

Regulations

1 Title

These regulations are the Road User Charges Amendment Regulations 2020.

2 Commencement

These regulations come into force on 1 July 2020.

3 Principal regulations

These regulations amend the Road User Charges Regulations 2012 (the principal regulations).

4 Regulation 3 amended (Interpretation)

(1)

In regulation 3(1), insert in their appropriate alphabetical order:

specialist RUC vehicle means the vehicles listed as specialist vehicles in section 5.11(2) of the VDAM Rule 2016

VDAM Rule 2016 means the Land Transport Rule: Vehicle Dimensions and Mass 2016

(2)

In regulation 3(1), definitions of B-train, semi-trailer, single large-tyred axle, and twin-tyred axle, replace “Part 2 of Land Transport Rule: Vehicle Dimensions and Mass 2002” with “the VDAM Rule 2016”.

5 Regulation 4 amended (RUC vehicle types and RUC weight bands)

In regulation 4(1), replace “a RUC vehicle (except type H vehicles)” with “RUC vehicles (except type H vehicles and overweight specialist RUC vehicles)”.

(2)

After regulation 4(2), insert:

(2A)

For the purposes of the Act, the RUC vehicle types and RUC vehicle weight bands for overweight specialist RUC vehicles are the types and weight bands specified in Part 3 of the Schedule.

(3)

In regulation 4(3), replace “However, despite” with “Despite”.

6 Schedule amended

(1)

In the Schedule, in the Part 1 heading, replace “type H vehicle” with “type H vehicles and overweight specialist RUC vehicles”.

(2)

In the Schedule, Part 2, item relating to Type H vehicle type 62, replace “permit weight of not more than 44 000 kg” with “permit weight of more than 42,000 kg but not more than 44,000 kg”.

(3)

In the Schedule, Part 2, item relating to Type H vehicle type 73, replace “permit weight of not more than 50 000 kg” with “permit weight of more than 48,000 kg but not more than 50,000 kg”.

In the Schedule, Part 2, item relating to Type H vehicle type 74, replace “permit weight of not more than 53 000 kg” with “permit weight of more than 50,000 kg but not more than 53,000 kg”.

In the Schedule, Part 2, after the item relating to Type H vehicle type number H96, insert:

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2020, amend the Road User Charges Regulations 2012 (the principal regulations) by specifying new RUC vehicle types for a number of new Type H vehicle types and for overweight specialist RUC vehicles (passenger service vehicles, concrete mixers, ground-spreader trucks, and rubbish trucks). These regulations also make minor amendments in relation to a number of Type H vehicle types currently specified in the principal regulations.

Regulatory impact assessment

The Ministry of Transport produced a regulatory impact assessment on 3 March 2020 to help inform the decisions taken by the Government relating to the contents of this instrument.
