Order

1 Title

This order is the COVID-19 Public Health Response (Alert Level Requirements) Amendment Order 2020.

2 Commencement

This order comes into force at 11.59 pm on 21 September 2020.

3 Principal order

4 Clause 7 replaced (Application)

Replace clause 7 with:

7 Application

(1)

Part 3 applies to the Auckland area.

(2)

The rest of this order applies to the whole of New Zealand.

(3)

However, see clause 9A, which provides that clause 27 applies outside the Auckland area in respect of certain public transport routes.

5 New clause 9A inserted (Face covering requirements on public transport services travelling certain routes)

After clause 9, insert:

9A Face covering requirements on public transport services travelling certain routes

(1)

If a vehicle that is in use as part of a public transport service travels on a specified route, clause 27 applies in respect of the entire specified route taken by that vehicle.

(2)

In this clause, specified route means a route that involves a vehicle travelling—

(a)

from an area to which Part 3 applies to an area to which Part 3 does not apply; or

(b)

between 2 areas to which Part 3 does not apply, if the vehicle passes through an area to which Part 3 applies; or

(c)

from an area to which Part 3 does not apply to an area to which Part 3 applies.

6 Clause 14 amended (Individuals must comply with physical distancing requirements for workplaces)

In clause 14(1)(b), delete “(if applicable)”.

7 Clause 19 amended (Physical distancing requirements for food and drink businesses and services)

In clause 19(2)(c), delete “if in the Auckland area”.

8 Clause 21 amended (Number limit for social gathering in Auckland area)

In the heading to clause 21, delete in Auckland area.

(2)

In clause 21(1), delete “in the Auckland area”.

9 Clause 22 revoked (Number limits for social gathering in other areas)

Revoke clause 22.

10 Clause 23 amended (Workers excluded from number limits)

In the heading to clause 23, replace limits with limit.

(2)

In clause 23, delete “or 22”.

11 Clause 24 amended (Individuals must comply with requirements for social gatherings)

In clause 24(1)(a), delete “or 22”.

12 Clause 25 amended (Organisers and persons in control of premises must comply with requirements for social gatherings)

In clause 25(1) and (2), delete “or 22”.

13 Clause 27 amended (Face covering requirements on public transport services)

In clause 27(3), revoke the definition of public transport service.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force at 11.59 pm on 21 September 2020, amends the COVID-19 Public Health Response (Alert Level Requirements) Order 2020 (the principal order).

The principal order is amended so that—

  • the alert level 2 requirements set out in Part 3 of that order continue to apply in the Auckland area but cease to apply to the rest of New Zealand; and

  • the rest of that order continues to apply to the whole of New Zealand.

In addition, the principal order is adjusted so that if a vehicle operating as part of a public transport service travels to, from, or through the Auckland area, people will be required to wear face coverings for the duration of the journey. This will be the case even though part of the journey may be through an area of New Zealand that is at alert level 1. Face coverings will not be required on public transport services where the entire journey takes place in an area that is at alert level 1.

This order must be approved by a resolution of the House of Representatives before the expiry of the period described in section 16(2) of the Act. If this does not happen, the order is revoked on the expiry of that period.
