This order is made under section 112 of the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Treaty of Waitangi Negotiations made in accordance with that section.

Order

1 Title

This order is the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou (Recognition of Customary Marine Title) Order 2020.

2 Commencement

This order comes into force on 1 February 2021.

3 Purpose

The purpose of this order is to recognise the customary marine title in each area of ngā rohe moana o ngā hapū o Ngāti Porou (ngā rohe moana) for which the responsible Minister has made a determination under section 111 of the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019.

4 Customary marine title recognised

(1)

Customary marine title is recognised in each area described in a schedule of this order.

(2)

The customary marine title hapū for an area are the hapū named for the area in the schedule.

(3)

The customary marine title hapū are recognised, on and from the effective date specified in the schedule, as having customary marine title in the area.

(4)

See Part 3 of the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019 for the mechanisms under that Act that affect customary marine title areas.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order comes into force on 1 February 2021. It recognises the customary marine title in each area of ngā rohe moana o ngā hapū o Ngāti Porou (ngā rohe moana) for which the Minister for Treaty of Waitangi Negotiations has made a determination under section 111 of the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019.

Part 3 of that Act sets out the mechanisms that apply to customary marine title areas that are recognised within ngā rohe moana.

Issued under the authority of the Legislation Act 2012.
