Proposed amendments

Hon David Parker, in Committee, to move the following amendments:

Clause 2

To omit this clause (lines 6 and 7 on page 3) and substitute the following clause:

2 Commencement
  • This Act comes into force on a date to be appointed by the Governor-General by Order in Council; and 1 or more Orders in Council may be made appointing different dates for different provisions and different purposes.

Clause 4

To insert the following definition in its appropriate alphabetical order:

Antarctica has the same meaning as in section 2(1) of the Antarctica Act 1960

Clause 8

To insert the following subclause after subclause (1) (after line 15 on page 8):

  • (1A) In addition, the Board may exercise its powers and carry out its functions and duties under this Act, as far as they are relevant, in relation to those parts of Antarctica outside the Ross Dependency.

Clause 24(1)

To omit 10(1)(b) and (d) (line 16 on page 15) and substitute 10(1)(b) or (d).

Clause 25(2)(a)

To omit this paragraph (lines 36 and 37 on page 15) and substitute the following paragraph:

  • (a) consult with any relevant national and international naming authorities that it considers appropriate; and

Clause 35(1)(a)

To omit the Ross Dependency (line 26 on page 19) and substitute Antarctica.

Schedule 1: clause 5

Paragraph (b) : to omit the Antarctic and substitute Antarctica; and.

To insert the following paragraph after paragraph (b) (after line 14 on page 23):

  • (c) if any committee is appointed, the chair of that committee.

Explanatory note

This Supplementary Order Paper makes the following changes to the Bill as introduced:

  • it changes the commencement date to a date to be appointed by the Governor-General by Order in Council, to ensure that the Act does not come into force until the requisite funding is allocated to enable the Board to undertake its additional functions under this Bill:

  • it provides a new definition and several corrections to specify the scope of the jurisdiction of the Board in terms of the Antarctica Act 1960 and to correct the citation of that place name:

  • the change to clause 25 clarifies the scope of the consultation required by that provision:

  • the change to clause 5 of Schedule 1 clarifies that the Board must appoint the chair of any committee that is established.
