Waste Minimisation Bill


Proposed amendments

Russel Norman, in Committee, to move the following amendments:

Clause 5(1)

To insert the following definition after the definition of disposal facility (after line 37 on page 10):

diverted material means any thing that is no longer required for its original purpose and, but for commercial or other waste minimisation activities, would be disposed of or discarded

Paragraph (a) of the definition of recovery: to insert after waste (line 10 on page 12) or diverted material.

Paragraph (b) of the definition of recovery: to insert after waste (line 12 on page 12) or diverted material.

Definition of recycling: to insert after waste (line 13 on page 12) or diverted material.

Definition of reuse: to omit in its (line 20 on page 12) and substitute or diverted material in their.

Definition of reuse: to omit waste, (line 22 on page 12) and substitute waste or diverted material,.

Definition of waste: to omit this definition (lines 2 to 10 on page 13) and substitute the following definition:

waste

  • (a) means any thing disposed of or discarded; and

  • (b) includes a type of waste that is defined by its composition or source (for example, organic waste, electronic waste, or construction and demolition waste); and

  • (c) to avoid doubt, includes any component or element of diverted material, if the component or element is disposed of or discarded

Definition of waste minimisation: to omit this definition (lines 18 and 19 on page 13) and substitute the following definition:

waste minimisation means—

  • (a) the reduction of waste; and

  • (b) the reuse, recycling, and recovery of waste and diverted material

Clause 5A(1)

To omit this subclause (lines 28 to 32 on page 13) and substitute the following subclause:

  • (1) In this Act, unless the context requires another meaning, disposal means—

    • (a) the final (or more than short-term) deposit of waste into or onto land set apart for that purpose; or

    • (b) the incineration of waste.


Explanatory note

This Supplementary Order Paper amends clauses 5 and 5A of Part 1 of the Waste Minimisation Bill. Clause 5 is the general interpretation provision for the Bill and contains the defined terms that are used throughout it. All the amendments to clause 5 relate to the inserting of a new definition, diverted material, to separate the concept of waste, which has no further use, from the concept of things that are source material for the purposes of reuse, recycling, and recovery processes. Accordingly, the following amendments are proposed:

  • to insert a new definition of diverted material:

  • to apply the definitions of recovery, recycling, and reuse to the new category of diverted material:

  • to amend the definition of waste to ensure it applies only to material that is disposed of or discarded:

  • to amend the definition of waste minimisation by clarifying that waste may be reduced, and waste and diverted material may be reused, recycled, and recovered.

The other amendment proposed by the SOP is to clause 5A of the Bill and clarifies that disposal of waste by incineration is not dependent on the waste having been deposited into or onto land set apart for that purpose.
