Local Government (Auckland Council) Bill

Proposed amendments

Hone Harawira, in Committee, to move the following amendments:

Part 1, Clause 3

To insert the following new paragraph (after line 4 on page 4)

  • “(ab) to provide for mana whenua representation on the Auckland Council, as required under the Treaty of Waitangi, and”.

Part 1, clause 4

To insert the following definitions in clause 4, in the appropriate alphabetical order:

“mana whenua means customary authority exercised by an iwi or hapū in an identified area

“mana whenua representative member means an elected person who has whakapapa links to the iwi or hapū in an identified area who exercise mana whenua

Part 2, Clause 8(1)

To insert “, and two mana whenua representative members” after “members” (on line 23 of page 6).

Part 2, Clause 8

To add the following new subsection (after line 32 on page 6):

  • “(4) Candidates for the position of mana whenua representative member will be selected by those iwi or hapū who exercise mana whenua in the Auckland region, and must be elected by the Māori electors of Auckland.”

Explanatory note

The Supplementary Order Paper amends the Local Government (Auckland Council) Bill to establish two mana whenua representative seats on the Auckland Council. It meets the original requirements of mana whenua representation expressed by the iwi of Ngati Whatua and Tainui, who exercise mana whenua in Auckland, and enables all Māori living in Auckland who are eligible to vote to participate in their election.
