Border (Customs, Excise, and Tariff) Processing Bill

Proposed motion to divide Bill into 2 Bills

Hon Maurice Williamson, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, Part 1, and Schedules 1 and 2 be a separate Bill, and that for the enacting words, clauses 1 and 2, and the Part 1 heading there be substituted the following enacting words and clauses:

The Parliament of New Zealand enacts as follows:

1 Title

  • This Act is the Customs and Excise Amendment Act 2009.

2 Commencement

  • (1) Section 12 comes into force on 1 October 2010.

    (2) Sections 10 and 11, Part 3 of Schedule 1, and Schedule 2 come into force on 1 January 2010.

    (3) The rest of this Act comes into force on the day after the date on which it receives the Royal assent.

That Part 2 and Schedule 3 be a separate Bill, and that for the Part 2 heading there be substituted the following enacting words and clauses:

The Parliament of New Zealand enacts as follows:

1 Title

  • This Act is the Tariff Amendment Act 2009.

2 Commencement

  • (1) Sections 28(1), 30, and 31 and Schedule 3 come into force on 1 January 2010.

    (2) Sections 26 and 27 come into force—

    • (a) on the day after the date on which this Act receives the Royal assent if the Tariff (AANZFTA) Amendment Act 2009 is in force on that day; or

    • (b) if the Tariff (AANZFTA) Amendment Act 2009 is not in force on that day, then immediately after the commencement of that Act.

    (3) The rest of this Act comes into force on the day after the date on which it receives the Royal assent.

Explanatory note

The motion set out on this Supplementary Order Paper divides the Border (Customs, Excise, and Tariff) Processing Bill into the following 2 Bills:

  • Customs and Excise Amendment Bill:

  • Tariff Amendment Bill.
