Subclause (1): to omit
“1 March 2011” (line 5 on page 2) and substitute
“the day that is 1 month after the date on which this Act receives the Royal assent”.
To omit this clause (lines 28 to 30 on page 4) and substitute the following clause:
Paragraph (b)(v) and (viii) of the definition of substance in section 31 are repealed.
This Supplementary Order Paper amends the Misuse of Drugs Amendment Bill (the Bill) in 2 ways.
First, it changes the commencement clause so that the provisions relating to ephedrine and pseudoephedrine will come into force 1 month after the date on which the Act receives the Royal assent. This change is necessary because the current commencement date in the Bill for these provisions has passed.
Secondly, it substitutes clause 13 so that tobacco products and herbal smoking products (as defined in section 2(1) of the Smoke-free Environments Act 1990), as well as hazardous substances, are not excluded from the restricted substances regime set out in the Misuse of Drugs Amendment Act 2005.
