Alcohol Reform Bill


Proposed motion to divide Bill into 3 Bills

Hon Judith Collins, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, Parts 1, 3, and 6, and the Schedules, be a separate Bill, and that the enacting words and clauses 1 and 2 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Sale and Supply of Alcohol Act 2012.

2 Commencement
  • (1) Sections 3, 4, 97, 98, 100, 100A, 117, 118, 120, 120A, 128 to 130, 289, 348, 390, and 399(2) come into force on the day 6 months after the date on which this Act receives the Royal assent.

    (2) Sections 12 to 59, 60 (except subsections (3) and (4)), 61 to 74, 80 to 96, 99, 101 to 116, 119, 121 to 127, 131 to 157, 174 to 288, 290 to 347, 349 to 381, 391 to 393, 395 to 398, 399(3), and the schedules come into force on the day 12 months after the date on which this Act receives the Royal assent.

    (3) Section 60(3) and (4) comes into force on the earlier of the following days:

    • (a) a date appointed by the Governor-General by Order in Council:

    • (b) the day 2 years after the date on which this Act receives the Royal assent.

    (4) The rest of this Act comes into force on the day after the date on which it receives the Royal assent.

That Part 9 be a separate Bill, and that the Part 9 heading and clauses 400 and 401 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Local Government (Alcohol Reform) Amendment Act 2012.

2 Commencement
  • This Act comes into force on the day 12 months after the date on which it receives the Royal assent.

3 Principal Act
  • This Act amends the Local Government Act 2002 (the principal Act).

That Part 10 be a separate Bill, and that the Part 10 heading and clauses 412 and 413 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Summary Offences (Alcohol Reform) Amendment Act 2012.

2 Commencement
  • This Act comes into force on the day 12 months after the date on which it receives the Royal assent.

3 Principal Act
  • This Act amends the Summary Offences Act 1981 (the principal Act).


Explanatory note

The motion set out on this Supplementary Order Paper splits the Alcohol Reform Bill into a Sale and Supply of Alcohol Bill, a Local Government (Alcohol Reform) Amendment Bill, and a Summary Offences (Alcohol Reform) Amendment Bill.

Part 9 of the present Bill becomes the Local Government (Alcohol Reform) Amendment Bill; and Part 10 of the present Bill becomes the Summary Offences (Alcohol Reform) Amendment Bill.

The rest of the present Bill (including the Schedules) becomes the Sale and Supply of Alcohol Bill.
