Criminal Procedure Legislation Bill


Proposed motion to divide Bill into 9 Bills

Hon Chester Borrows, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, Part 1 and Schedule 1 be a separate Bill, and that the enacting words, clauses 1 and 2, and the Part 1 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Criminal Procedure Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

That subpart 1 of Part 2 be a separate Bill, and that the Part 2 and subpart 1 headings and clause 18 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Auctioneers Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Auctioneers Act 1928 (the principal Act).

That subpart 2 of Part 2 and Schedule 2 be a separate Bill, and that the subpart 2 heading and clause 20 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Crimes Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Crimes Act 1961 (the principal Act).

That subpart 3 of Part 2 be a separate Bill, and that the subpart 3 heading and clause 25 be replaced with:

The Parliament of New Zealand enacts as follows:

  • This Act is the Criminal Disclosure Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Criminal Disclosure Act 2008 (the principal Act).

That subpart 3A of Part 2 be a separate Bill, and that the subpart 3A heading and clause 27B be replaced with:

  • This Act is the Evidence Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Evidence Act 2006 (the principal Act).

That subpart 4 of Part 2 be a separate Bill, and that the subpart 4 heading and clause 28 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Juries Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Juries Act 1981 (the principal Act).

That subpart 5 of Part 2 be a separate Bill, and that the subpart 5 heading and clause 31 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Misuse of Drugs Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Misuse of Drugs Act 1975 (the principal Act).

That subpart 5A of Part 2 be a separate Bill, and that the subpart 5A heading and clause 32A be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Sentencing Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Sentencing Act 2002 (the principal Act).

That subpart 6 of Part 2 be a separate Bill, and that the subpart 6 heading and clause 33 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Summary Offences Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 July 2013.

3 Principal Act
  • This Act amends the Summary Offences Act 1981 (the principal Act).
