Family Court Proceedings Reform Bill


Proposed motion to divide Bill into 10 Bills

Hon Judith Collins, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, and Part 1 be a separate Bill, and that the enacting words, clauses 1 and 2, and the Part 1 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Care of Children Amendment Act 2013.

2 Commencement
  • (1) The following provisions come into force on the day after the date on which this Act receives the Royal assent:

    • (a) section 9, to the extent only that it inserts new sections 46EA, 46EB, and 46FA into the principal Act:

    • (b) section 29(1) and (5).

    (2) The rest of this Act comes into force on a date appointed by the Governor-General by Order in Council.

    (3) Any provision that has not earlier been brought into force comes into force on 1 October 2014.

That Part 2 be a separate Bill, and that the Part 2 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Domestic Violence Amendment Act 2013.

2 Commencement
  • (1) The following provisions come into force on the day after the date on which this Act receives the Royal assent:

    • (a) section 35:

    • (b) section 51(1):

    • (c) section 52A, to the extent only that it inserts the Part 2A heading, new sections 51A and 51B, and the cross-heading above section 51B into the principal Act:

    • (d) section 54(1).

    (2) The rest of this Act comes into force on a date appointed by the Governor-General by Order in Council, and 1 or more Orders in Council may be made bringing different provisions into force on different dates.

    (3) Any provision that has not earlier been brought into force comes into force on 1 October 2014.

That Part 3 be a separate Bill, and that the Part 3 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Family Dispute Resolution Act 2013.

2 Commencement
  • (1) This Act (except sections 60B and 60C) comes into force on the day after the date on which this Act receives the Royal assent.

    (2) Sections 60B and 60C come into force on 1 October 2014 unless they are earlier brought into force on a date appointed by the Governor-General by Order in Council.

That Part 4 be a separate Bill, and that the Part 4 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Legal Services Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 October 2014 unless it is earlier brought into force on a date appointed by the Governor-General by Order in Council.

That subpart 1 of Part 5 be a separate Bill, and that the Part 5 heading and the subpart 1 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Child Support Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 October 2014 unless it is earlier brought into force on a date appointed by the Governor-General by Order in Council.

That subpart 2 of Part 5 be a separate Bill, and that the subpart 2 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Children, Young Persons, and Their Families Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 October 2014 unless it is earlier brought into force on a date appointed by the Governor-General by Order in Council.

That subpart 2A of Part 5 be a separate Bill, and that the subpart 2A heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Family Courts Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 October 2014 unless it is earlier brought into force on a date appointed by the Governor-General by Order in Council.

That subpart 3 of Part 5 be a separate Bill, and that the subpart 3 heading be replaced with:

  • This Act comes into force on 1 October 2014 unless it is earlier brought into force on a date appointed by the Governor-General by Order in Council.

That subpart 5 of Part 5 be a separate Bill, and that the subpart 5 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title
  • This Act is the Protection of Personal and Property Rights Amendment Act 2013.

2 Commencement
  • This Act comes into force on 1 October 2014 unless it is earlier brought into force on a date appointed by the Governor-General by Order in Council.

The motion set out on this Supplementary Order Paper divides the Family Court Proceedings Reform Bill into the following 10 Bills:
