Proposed amendments

Hon Craig Foss, in Committee, to move the following amendments:

Clause 13

Replace clause 13(3) (lines 8 to 10 on page 11) with:

  • (3) An order under subsection (1) and an exemption under subsection (2) are legislative instruments and disallowable instruments for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of that Act.

Clause 15

Replace clause 15(2) (lines 15 to 17 on page 12) with:

  • (2) An order under subsection (1) and an order under subsection (1A) are legislative instruments and disallowable instruments for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of that Act.

Clause 18

Replace clause 18(5) (lines 11 to 13 on page 15) with:

  • (5) An order under subsection (2)(a) and an exemption under subsection (3) are legislative instruments and disallowable instruments for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of that Act.

Clause 22

Replace clause 22(5) (lines 26 to 28 on page 19) with:

  • (5) An order under subsection (2)(a) and an exemption under subsection (3) are legislative instruments and disallowable instruments for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of that Act.

Clause 25

Replace clause 25(2) (lines 22 and 23 on page 21) with:

  • (2) An order under subsection (1)(a) is a legislative instrument and a disallowable instrument for the purposes of the Legislation Act 2012 and must be presented to the House of Representatives under section 41 of that Act.


Explanatory note

This Supplementary Order Paper replaces SOP No 169. The amendments are consequential on the coming into force of the Legislation Act 2012, which repealed the Acts and Regulations Publication Act 1989 and the Regulations (Disallowance) Act 1989 and replaced them with a broadly similar regime.
