Environment Canterbury (Transitional Governance Arrangements) Bill

Proposed amendments

Hon Dr Nick Smith, in Committee, to move the following amendments:

Clause 4A

In clause 4A, replace Schedule 1 (page 6, line 8) with Schedules 1 and 2.

Clause 19

Delete clause 19(1)(a)(iii) (page 12, lines 8 and 9).

In clause 19(1)(b)(ii), delete “; and” (page 12, line 16).

Delete clause 19(1)(b)(iii) (page 12, lines 17 and 18).

Schedule 2

In the Schedule 2 heading, before Schedule 1 cl 5 (page 22, line 4), insert s 4A,.

Explanatory note

This Supplementary Order Paper changes clause 19 of the Environment Canterbury (Transitional Governance Arrangements) Bill. Tests in clause 19 determine whether Part 3 of the Bill applies to a proposed planning document.

The change is to remove the third test in clause 19. That third test was that the proposed planning document be consistent with the vision and principles of the Canterbury Water Management Strategy. (Clause 23, which is unchanged by this Supplementary Order Paper, still requires those making decisions about a proposed planning document to have particular regard to the vision and principles of the Canterbury Water Management Strategy.)

This Supplementary Order Paper also makes a small technical change to insert a cross-reference to Schedule 2 into clause 4A. There is a related adjustment to the shoulder reference in Schedule 2.

Departmental disclosure statement

The Ministry for the Environment is required to prepare a disclosure statement to assist with the scrutiny of this Supplementary Order Paper. The disclosure statement provides access to information about any material policy changes to the Bill and identifies any new significant or unusual legislative features of the Bill as amended.
