Drug and Alcohol Testing of Community-based Offenders, Bailees, and Other Persons Legislation Bill

Proposed motion to divide Bill into 5 Bills

Hon Judith Collins, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, Part 1, and Schedule 1 be a separate Bill, and that the enacting words, clauses 1 and 2, and the Part 1 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title

This Act is the Bail (Drug and Alcohol Testing) Amendment Act 2016.

2 Commencement

(1)

This Act comes into force on the earlier of the following:

(a)

a date appointed by the Governor-General by Order in Council:

(b)

the day immediately after the expiry of the 6-month period.

(2)

The 6-month period is the period of 6 months that commences on the date on which this Act receives the Royal assent.

That Part 2 and Schedule 2 be a separate Bill, and that the Part 2 heading be replaced with:

The Parliament of New Zealand enacts as follows:

This Act is the Parole (Drug and Alcohol Testing) Amendment Act 2016.

2 Commencement

(1)

This Act comes into force on the earlier of the following:

(a)

a date appointed by the Governor-General by Order in Council:

the day immediately after the expiry of the 6-month period.

(2)

The 6-month period is the period of 6 months that commences on the date on which this Act receives the Royal assent.

That Part 3 and Schedule 3 be a separate Bill, and that the Part 3 heading be replaced with:

This Act is the Sentencing (Drug and Alcohol Testing) Amendment Act 2016.

2 Commencement

This Act is the Public Safety (Public Protection Orders) (Drug and Alcohol Testing) Amendment Act 2016.

2 Commencement

This Act comes into force on the earlier of the following:

(a)

a date appointed by the Governor-General by Order in Council:

the day immediately after the expiry of the 6-month period.

(2)

The 6-month period is the period of 6 months that commences on the date on which this Act receives the Royal assent.

That Part 5 and Schedule 4 be a separate Bill, and that the Part 5 heading be replaced with:

The Parliament of New Zealand enacts as follows:

This Act is the Returning Offenders (Management and Information) (Drug and Alcohol Testing) Amendment Act 2016.

2 Commencement

(1)

This Act comes into force on the earlier of the following:

(a)

a date appointed by the Governor-General by Order in Council:

(b)

the day immediately after the expiry of the 6-month period.

(2)

The 6-month period is the period of 6 months that commences on the date on which this Act receives the Royal assent.

Explanatory note

This Supplementary Order Paper replaces Supplementary Order Paper No 162. It sets out a motion to divide the Drug and Alcohol Testing of Community-based Offenders, Bailees, and Other Persons Legislation Bill into the following 5 Bills:

  • Parole (Drug and Alcohol Testing) Amendment Bill:

  • Sentencing (Drug and Alcohol Testing) Amendment Bill:
