Te Ture Whenua Māori Bill

Proposed motion to divide Bill into 3 Bills

Hon Te Ururoa Flavell, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, Parts 1 to 9, and Schedules 1 to 4 be a separate Bill, and that the enacting words and clauses 1 and 2 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title

This Act is Te Ture Whenua Māori Act 2017.

2 Commencement

(1)

This Act comes into force on a date or dates set by Order in Council, and 1 or more orders may be made bringing different provisions into force on different dates and for different purposes.

(2)

Any provision that is not already in force at the end of the 18-month period that starts on the date of Royal assent comes into force then.

(3)

In this section, provision includes any item or part of an item in any of the schedules.

That Parts 10 to 15 and Schedules 5 to 7 be a separate Bill, and that, above the Part 10 heading, there be inserted:

This Act is Te Kooti Whenua Māori Act 2017.

2 Commencement

(1)

This Act comes into force on a date or dates set by Order in Council, and 1 or more orders may be made bringing different provisions into force on different dates and for different purposes.

(2)

Any provision that is not already in force at the end of the 18-month period that starts on the date of Royal assent comes into force then.

(3)

In this section, provision includes any item or part of an item in any of the schedules.

That Part 16 and Schedules 8 to 12 be a separate Bill, and that the heading to Part 16 be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title

This Act is Te Ture Whenua Māori (Repeals and Amendments) Act 2017.

2 Commencement

(1)

This Act comes into force on a date or dates set by Order in Council, and 1 or more orders may be made bringing different provisions into force on different dates and for different purposes.

(2)

Any provision that is not already in force at the end of the 18-month period that starts on the date of Royal assent comes into force then.

(3)

Subsections (1) and (2) apply with the following exceptions:

(a)

subpart 3 comes into force on the day after the date of Royal assent:

(b)

subpart 4 comes into force on the first 1 July that falls—

(i)

at least 9 months after the date of Royal assent; and

(ii)

after the date on which all of Te Ture Whenua Māori Act 2017 has come into force.

(4)

In this section, provision includes any item or part of an item in any of the schedules.

Explanatory note

This Supplementary Order Paper divides Te Ture Whenua Māori Bill into the following 3 Bills:

  • Te Ture Whenua Māori (Repeals and Amendments) Bill.
