COVID-19 Response (Further Management Measures) Legislation Bill

Proposed amendments

Hon Chris Hipkins, in Committee, to move the following amendments:

Schedule 10

In Schedule 10, clause 2, replace new clause 3A(6) (page 97, lines 32 to 37) with:

In this clause, COVID-19 lockdown period means the period during which any order or other restriction is in force under section 70(1)(f), (g), (h), (i), (la), or (m) of the Health Act 1956, or section 11 of the COVID-19 Public Health Response Act 2020, that—

(a)

relates to COVID-19; and

(b)

results in an affected person being unable to operate the affected food business.

Schedule 15

In Schedule 15, clause 6, replace new section 120A(5) (page 118, lines 26 to 32) with:

In this section, COVID-19 restricted movement period means a period during which the movement of electors for the election described in subsection (1)(a) is restricted to an extent that may deny them a reasonable opportunity to cast a valid vote in the election, or premises on which functions related to that election will be undertaken are required to be closed, because of—

(a)

an order or other restriction under section 70(1) of the Health Act 1956 that relates to COVID-19; or

(b)

an order under section 11 of the COVID-19 Public Health Response Act 2020.

Explanatory note

This Supplementary Order Paper amends 2 clauses in the COVID-19 Response (Further Management Measures) Legislation Bill that calculate periods of time with reference to an order or other restriction under section 70 of the Health Act 1956. In both cases, a reference to an order made under the COVID-19 Public Health Response Act 2020 is added to the new clause so that the calculation of the period of time can also be done with reference to an order made under that Act.
