Veterans’ Support Amendment Bill (No 2)

Proposed amendments

Hon Ron Mark, in Committee, to move the following amendments:

Clause 12

In clause 12, new section 29(1)(b), replace “Parts 3, 4, and 5” (page 7, line 16) with “Part 3, 4, or 5”.

In clause 12, new section 29(3), replace the definition of prisoner (page 7, line 37) with:

prisoner means,—

(a)

for a prison referred to in paragraph (a) of the definition of prison, a prisoner within the meaning of section 3(1) of the Corrections Act 2004; or

(b)

for a prison referred to in paragraph (b) of that definition, a service prisoner within the meaning of section 2(1) of the Armed Forces Discipline Act 1971; or

(c)

for a prison referred to in paragraph (c) of that definition, a person for the time being in legal custody in that prison

Clause 15

Replace clause 15 (page 8, line 34 to page 9, line 10) with:

15 Section 81 amended (Entitlement to children’s bursary)

After section 81(1)(b), insert:

(c)

if the child resides overseas, study overseas that is equivalent to the study described in paragraph (a) or (b).

New clause 31A

After clause 31 (page 12, after line 24), insert:

31A Schedule 1 amended

In Schedule 1, after Part 4, insert:

22 Transitional ITOs as tertiary education organisations

(1)

This Part applies during the transition period.

(2)

Despite the definition of tertiary education organisation in section 81(5), a transitional ITO must also be treated as a tertiary education organisation for the purposes of section 81(1)(b).

(3)

In this clause, transitional ITO and transition period have the same meanings as in clause 26 of Schedule 1 of the Education and Training Act 2020.

Explanatory note

This Supplementary Order Paper amends the Veterans’ Support Amendment Bill (No 2) to—

  • amend clause 12 by—

    • replacing the definition of prisoner in new section 29(3) of the Veterans’ Support Act 2014 (the principal Act) with a definition that aligns with the new definition of prison in new section 29(3):

    • making a minor amendment to new section 29(1)(b) by correcting a cross-reference to Parts 3 to 5 of the principal Act:

  • replace clause 15, which amends section 81 of the principal Act. Some of the amendments made by that clause (new subsection (1)(b) and new subsection (5)) are no longer needed because equivalent amendments are made by Schedule 24 of the Education and Training Act 2019. New subsection (1)(c) is still required and is inserted by new clause 15:

  • insert clause 31A, which inserts new Part 5 into Schedule 1 (transitional, savings, and related provisions) of the principal Act. New Part 5 is related to the amendment to section 81 of the principal Act made by Schedule 24 of the Education and Training Act 2019. It provides that, during the transition period relating to the work-based training provisions of Schedule 1 of the Education and Training Act 2019, a transitional ITO (industry training organisation) (as defined in that schedule) must also be treated as a tertiary education organisation for the purposes of section 81 of the principal Act.

Departmental disclosure statement

Veterans’ Affairs New Zealand considers that a departmental disclosure statement is not required to be prepared for this Supplementary Order Paper.
