Environmental Protection Authority Bill


Proposed amendments

Charles Chauvel, in Committee, to move the following amendments:

Heading to clause 7

To omit Crown entity (line 8 on page 10) and substitute autonomous Crown entity.

Clause 7(1)

To omit Crown entity (line 9 on page 10) and substitute autonomous Crown entity.

Clause 11(1)

To add the following paragraph (after line 20 on page 11):

  • (c) protects, maintains, and enhances New Zealand's environment.

Clause 12

To add the following paragraphs (after line 15 on page 12):

  • (e) to protect and enhance the coastal and marine environment, and to carry out the environmental management of New Zealand's Exclusive Economic Zone:

  • (f) to carry out the administration of the Waste Minimisation Act 2008.


Explanatory note

This Supplementary Order Paper amends the Environmental Protection Authority Bill as follows:

  • Clause 7: The bill as currently drafted does not provide that the EPA is an autonomous Crown entity. This is an oversight that limits the EPA's ability to operate free of political interference. The proposed amendment provides that the EPA is an autonomous Crown entity.

  • Clause 11: As currently drafted, the bill does not provide that the protection of the environment is an objective of the EPA. This is an oversight as protecting and enhancing the environment must be a key focus of the Authority in all its work. The amendment provides that environmental protection is an objective of the EPA.

  • Clause 12: The EPA, as proposed, does not have comprehensive functions. Further functions are to be added later, at an unspecified date. The amendments to add additional functions will allow the EPA to become more comprehensive and effective from its inception.
