In clause 6, new section 1A(1) (line 25 on page 8), replace
“manage”, and after
“New Zealand” (line 27 on page 8), insert
“and to promote health and safety, sustainability and the protection of the environment in these activities”.
This Supplementary Order Paper amends clause 6 of the Crown Minerals (Permitting and Crown Land) Bill to change the purpose of the legislation to “manage” mining in New Zealand rather than “promote” to better fit the true purpose of the regime. Given the new powers being granted to the Minister of Energy and Resources to allow access for mining activities on conservation land, it is particularly important that the purpose of this Act not create a direct conflict of interest for the Minister by legislating his or her role as one of “promoting” mining activities with no regard to the effect on the conservation estate. In addition this amendment ensures that the purpose section reflects health and safety, sustainability, and environmental principles to provide balance to the other aims in the purpose section.
