Gambling (Gambling Harm Reduction) Amendment Bill


Proposed amendments

Hon Trevor Mallard, in Committee, to move the following amendments:

New clause 20

After clause 19 (after line 14 on page 8), insert:

20 Section 172 amended (Restricted hours of operation)
  • In section 172(1), after 1 pm, insert or on any other day between the hours of 4 am and 9 am.

New clause 21

After clause 19 (after line 14 on page 8), insert:

21 New section 84A inserted (Restricted hours of operation at class 4 venues)
  • After section 84, insert:

    84A Restricted hours of operation at class 4 venues
    • (1) A holder of a class 4 venue licence or class 4 operator’s licence must not conduct gambling on Christmas Day, Good Friday, or on Anzac Day between the hours of 3 am and 1 pm or on any other day between the hours of 4 am and 9 am.

      (2) A holder of a class 4 venue licence or class 4 operator’s licence who contravenes subsection (1) commits an offence and is liable on conviction to a fine not exceeding $10,000.

      (3) The Governor-General may, by Order in Council, make regulations prescribing the days on, and the hours during, which a class 4 venue may conduct gambling and the activities that may be undertaken.

      (4) Regulations made under subsection (3) must not override subsection (1) but may impose restrictions that are additional to the restrictions in that subsection.


Explanatory note

This Supplementary Order Paper amends the Gambling (Gambling Harm Reduction) Amendment Bill, which as currently drafted does not restrict the hours of gambling operations.

This Supplementary Order Paper amends the Bill to provide that, in addition to restrictions already provided for in relation to certain public holidays, casino gambling must not be conducted on any other day between the hours of 4 am and 9 am.

This Supplementary Order Paper also amends the Bill to provide for restricted hours of operation at class 4 venues.

These amendments will ensure that problem gamblers are not able to gamble for an unrestricted period of time.
