Proposed amendment
Dr Russel Norman, in Committee, to move the following amendment:
Clause 12
Replace clause 12 (lines 18 to 35 on page 12) with:
12 Section 14 amended (Interceptions not to target domestic communications)
In section 14, after
“intercepting”insert“or otherwise obtaining”.
Explanatory note
This Supplementary Order Paper amends the Government Communications Security Bureau and Related Legislation Amendment Bill. The communications of New Zealand citizens or permanent residents should not be intercepted or obtained by the GCSB, which should remain a foreign intelligence gathering agency. This amendment reverts to the existing section 14 of the Government Communications Security Bureau Act 2003 (Interceptions not to target domestic communications) by clarifying that the GCSB may not intercept or otherwise obtain the communication of a New Zealander.
