Clause 5
In clause 5(5), after “information,”
(line 7 on page 6), insert “and after
.‘medium’
, insert ‘and includes metadata’
”
Explanatory note
This Supplementary Order Paper amends the Government Communications Security Bureau and Related Legislation Amendment Bill. There is currently no restriction in the Bill relating to the collection of metadata. There has been extensive confusion as to whether metadata is considered as a communication. Metadata is highly valuable, as it can reveal more than an actual communication, and therefore is worthy of protection alongside the content of communication. To avoid confusion, and to acknowledge the importance of metadata, this amendment includes metadata in the definition of communication.
