Building (Pools) Amendment Bill

Proposed amendments

Metiria Turei, in Committee, to move the following amendments:

Clause 6C

Delete clause 6C (page 4, line 29 to page 5, line 8).

Clause 7

In clause 7, new section 162CA(3), in paragraph (c) of the definition of certificate of periodic inspection, delete “(subject to any waiver or modification granted under section 67A or 188) (page 7, lines 3 and 4)”.

Clause 10A

Delete clause 10A (page 8, lines 8 to 14).

Clause 13

In clause 13, new section 450A(3) delete the definition of fence (page 9, lines 21 and 22).

In clause 13, new section 450A(3), in the definition of fencing, replace fencing means” (page 9, line 23), with fence and fencing mean”.

Schedule

In Part 2 of the Schedule, in the item relating to the Building Regulations 1992 (SR 1992/150), in Schedule 1, new clause F9.3.2(a), delete “(and may enclose the whole or part of the immediate pool area)” (page 13, lines 16 to 18).

In Part 2 of the Schedule, in the item relating to the Building Regulations 1992 (SR 1992/150), in Schedule 1, replace new clause F9.3.4 (page 13, line 35 to page 14, line 7) with:

F9.3.4

Where a building forms all or part of an immediate pool area barrier, there must be no windows, doors, or other openings to the immediate pool area in the part of the building that forms the barrier.

Explanatory note

This Supplementary Order Paper would require all residential pools to have a barrier restricting access from all 4 sides. The Supplementary Order Paper requires a building forming part of that barrier to have no windows, doors, or other openings in it to the pool area. It also removes any discretion to waive the requirements set out in clause 7, new section 162C to have a compliant means of restricting access to a residential pool.
