Environment Canterbury (Democracy Restoration) Amendment Bill

Proposed amendments

Dr Megan Woods, in Committee, to move the following amendments:

Clause 1

In clause 1, delete “Amendment” (page 1, line 3).

Clause 3

Delete clause 3 (page 1, lines 8 to 10).

Clause 5

Replace clause 5 (page 2, lines 1 to 8) with:

5 Election to be called

(1)

The governing body of Environment Canterbury must immediately instruct the electoral officer under section 8 of the Local Electoral Act 2001 to hold a special election to replace the members appointed under section 12 of the Environment Canterbury (Transitional Governance Arrangements) Act 2016 in accordance with section 6.

(2)

The special election referred to in subsection (1) must be held no later than 3 months after the commencement of this Act.

6 Process for electing members

(1)

Six elected members must be elected—

(a)

using the First Past the Post electoral system (as described generally in section 5A of the Local Electoral Act 2001); and

(b)

by the electors described in the rest of this section.

(2)

One member must be elected by electors within the districts of the following local authorities (the South Canterbury constituency):

(a)

Mackenzie District Council; and

(b)

Timaru District Council; and

(c)

Waimate District Council; and

(d)

that part of the Waitaki District Council that is also within the Canterbury region.

(3)

One member must be elected by electors within the districts of the following local authorities (the mid-Canterbury constituency):

(a)

Selwyn District Council; and

(b)

Ashburton District Council.

(4)

One member must be elected by electors within the districts of the following local authorities (the North Canterbury constituency):

(a)

Waimakariri District Council; and

(b)

Hurunui District Council; and

(c)

Kaikoura District Council.

(5)

Three members must be elected, at large, by electors within the district of the Christchurch City Council.

7 Environment Canterbury (Transitional Governance Arrangements) Act 2016 repealed

The Environment Canterbury (Transitional Governance Arrangements) Act 2016 (2016 No 20) is repealed on the day after the day on which the official result of the special election held under section 5 is declared under section 86 of the Local Electoral Act 2001.

Explanatory note

This Supplementary Order Paper amends the Environment Canterbury (Democracy Restoration) Amendment Bill to reflect recent changes in the legislative framework around this issue. Clause 5 is replaced with new provisions that provide for a special election to be held to replace the members appointed under section 12 of the Environment Canterbury (Transitional Governance Arrangements) Act 2016. This ensures that full local democracy will be restored to the region served by Environment Canterbury. Amendments to clause 1 (Title) and clause 3 (Principal Act) reflect the fact the Bill is technically no longer an amendment Bill.
