Resource Legislation Amendment Bill

Proposed amendments

David Seymour, in Committee, to move the following amendments:

Clause 5

After clause 5, new section 6(h) (page 22, after line 20), insert:

(i)

the protection of private property rights:

(j)

the effective functioning of the build environment, including the availability of land to support changes in population and urban development demand:

(k)

the efficient provision of infrastructure:

(l)

the efficient use and development of natural and physical resources, including the benefits derived from their use and development.

New clause 5A

After clause 5 (page 22, after line 20), insert:

5A Section 7 amended (Other matters)

(1)

Delete section 7(b).

(2)

In section 7(d), replace “intrinsic values” with “effective functioning”.

Explanatory note

This Supplementary Order Paper amends the Resource Legislation Amendment Bill to recognise the importance of—

  • the rights of property owners to use their land as they wish (unless it is necessary to restrict those rights under the Resource Management Act 1991);

  • having flexible land supply to support changes in population and urban development demand;

  • the construction and operation of infrastructure; and

  • the benefits accruing to a region from the use and development of natural and physical resources within that region.

The wording of clause 5, new section 6(i) to (l) and new clause 5A, section 7(d) is from the Resource Management Summary of Reform Proposals 2013.
