Electoral (Integrity) Amendment Bill

Proposed amendment

Chris Bishop, in Committee, to move the following amendment:

New clause 5A

After clause 5 (page 4, after line 16), insert:

5A New section 59A inserted (High Court ruling on the New Zealand Bill of Rights Act)

After section 59, insert:

59A High Court ruling on the New Zealand Bill of Rights Act

No party leader may give notice under section 55C if the High Court issues a declaratory judgement that they are in breach of the New Zealand Bill of Right Act, notwithstanding section 4 of the Act.

Explanatory note

This Supplementary Order Paper amends the Electoral (Integrity) Amendment Bill to insert new clause 5A to provide the judiciary the opportunity to rule on whether the member of Parliament expulsion provisions breach the Bill of Rights Act. If so, the Speaker is prohibited from enforcing the provisions to trigger the expulsion of a member of Parliament.
