Hon Nikki Kaye, in Committee, to move the following amendment:

Clause 15

In clause 15(2), replace new section 292A(4) (page 7, lines 4 and 5) with:

A person who commits an offence against subsection (3) is liable on conviction to a fine not exceeding $10,000.

Explanatory note

This Supplementary Order Paper amends the Education Amendment Bill. It increases the fine for a person who commits false representation for the purpose of receiving, or continuing to receive, free tertiary education from a tertiary education organisation from $5,000 to $10,000. The quantum of the current fine is unlikely to be an adequate deterrent, as the potential benefit of the fees-free policy outweighs the cost of the fine if caught.
