Proposed amendments

Clause 16

In clause 16, replace paragraph (m) (page 10, lines 30 and 31) with:

require that the relevant person allow themselves to be photographed and provide other identifying particulars:

In clause 16, insert as subclause (2) (page 10, after line 41):

In this section, identifying particulars has the same meaning as in section 32(5) of the Policing Act 2008.

Explanatory note

This Supplementary Order Paper amends the Terrorism Suppression (Control Orders) Bill by including an example of a requirement to provide identifying particulars, to strengthen the Bill and align it with other New Zealand legislation.

The Bill as introduced has an example of a requirement that the relevant person allow themselves to be photographed and impressions made of their fingerprints. This has the potential to be interpreted in a limited manner, and does not align with other New Zealand legislation. The reference to taking fingerprints should be replaced with a requirement to provide “identifying particulars”, with the same meaning as in section 32(5) of the Policing Act 2008. This is similar to provisions in the Returning Offenders (Management and Information) Act 2015. It is important that the returnee’s palm-prints and footprints are also recorded by Police for the management of the returnee.
