Clause 31

Replace clause 31(2) (page 16, lines 12 to 15) with:


A person who commits an offence under this section is liable on conviction to imprisonment for a term not exceeding 5 years.

Explanatory note

This Supplementary Order Paper amends the Terrorism Suppression (Control Orders) Bill by increasing the term of imprisonment for the offence of breaching a control order.

The Bill as introduced contains an offence for breaching the requirements of a control order, with liability on conviction to a term of imprisonment not exceeding 1 year or a fine not exceeding $2,000. National is of the view that the punishment does not reflect the seriousness of the potential crime committed and harm caused. We recommend removing the monetary fine, and increasing the term of imprisonment. National recommends a term of imprisonment of 5 years, which aligns with the Australian penalty for the offence of breaching a control order.
