The Short Title of this Act shall be “The Otago Southern Trunk Railway Amendment Act 1867.”

It shall be lawful for the promoters of the undertaking to abandon the making of that portion of the railway authorized by the said “Otago Southern Trunk Railway Act 1866” to be made constructed and maintained commencing at the terminus in the said Act described in the City of Dunedin in the Province of Otago and terminating at a point on land marked number ten in the Taieri District in the said Province on the deposited plan of the said line of railway and also marked nine miles on such plan and being sixty-five chains or thereabouts south-westward from the farm buildings of Springfield situated in the said Taieri District and to make construct and maintain instead thereof a railway with proper works approaches and conveniences connected therewith to join at the said point in the said Taieri District that portion of the railway authorized to be made constructed and maintained by the said Act which is not by this Act authorized to be abandoned commencing at a point situate at or near the line of the southern side of High Street about seven chains eastward from the Custom House in the said City of Dunedin and passing from in through or into the following city and territorial divisions of the said Province viz. the City of Dunedin the Town District the Lower Kaikorai District the Dunedin and East Taieri District and the Taieri District and terminating at the said point on said land numbered ten in the said Taieri District on the said deposited plan and marked nine miles on such plan as the line of the portion of railway hereby authorized to be substituted is set forth on the deposited plan thereof and described in the book of reference or within the limits of deviation set forth on such plan being a distance of one hundred yards on either side of the said last mentioned line and passes through over or under the several sections streets roads and places enumerated in the Schedule hereto annexed.

The promoters of the undertaking shall erect and at all times maintain four good and sufficient gates across the said railway at the points where the said railway crosses on a level Jetty Street and Rattray Street in the said City of Dunedin and shall employ proper persons to open and shut such gates and such gates shall be kept constantly closed across such railway save and except when engines or carriages passing along the railway shall have occasion to cross the said streets under a penalty of forty shillings for every default therein.

All departing or arriving trains on the said railway shall not cross the said Jetty Street and Rattray Street in the said City of Dunedin or either of them at any greater rate of speed than four miles an hour under a penalty of forty shillings for every default therein.

“The Otago Southern Trunk Railway Act 1866” shall henceforth be read and construed and shall operate and take effect in the same manner in every respect as if the portion of railway hereby authorized to be substituted for the portion of railway hereby authorized to be abandoned had been a portion of the railway by that Act authorized to be made and had with the portion of the railway by that Act authorized to be made and not hereby authorized to be abandoned been the railway by that Act authorized to be made constructed and maintained instead of the railway thereby authorized to be made constructed and maintained and the promoters of the undertaking shall accordingly be entitled to and to exercise and to enjoy the full benefit of all such powers and rights and to do all such matters and things in and for and in relation to the making constructing maintaining and dealing with the said portion of railway hereby authorized to be substituted and the said portion of railway not hereby authorized to be abandoned and every or any part thereof respectively as in such case the promoters of the undertaking would have been entitled to or to exercise enjoy or do under such Act.
