WHEREAS the lands more particularly described in the Schedule hereto annexed have been heretofore set aside and reserved by the Governor for the use of the Southland Agricultural and Pastoral Association: And whereas for the better carrying out of the trusts, purposes, and objects in and for which the land hereinbefore mentioned was reserved, it is desirable to vest the said lands in Trustees, and to provide for the management of the same;

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Southland Agricultural and Pastoral Association Reserve Act, 1877.”

2 Lands vested in Trustees.

The lands described in the Schedule hereto shall be and are hereby absolutely vested in George Frederick Martin, of Invercargill, auctioneer; John Walker Mitchell, of Invercargill, merchant; Christopher Basstian, of Dunrobin, runholder; the Honorable James Alexander Robertson Menzies, of Dunallister, gentleman; and David McKellar, of Invercargill, gentleman; all in the Provincial District of Otago, as Trustees to hold the said lands for the use of the Southland Agricultural and Pastoral Association, and for the purposes for which such association was formed.

3 Certificate of title to be granted.

The District Land Registrar of Southland shall, on the deposit with him of a copy of this Act, grant a certificate of title of the said land vested by this Act to the said “Southland Agricultural and Pastoral Association Reserve Trust.”

4 New Trustees how appointed.

If any member of the said Trust shall, by writing under his hand addressed to the Governor or to the said Trustees, resign, or shall be absent from the Provincial District of Otago for twelve months, or shall be adjudged a bankrupt or insolvent within the meaning of any Bankrupt or Insolvency Act, or take the benefit of any Act for the relief of debtors, or shall be convicted of any felony, such person shall cease to be a Trustee, and the Governor may, in case of any such vacancy, or in case of the death of any Trustee, appoint another or others in his place.

5 Uses of reserve.

The Trustees shall permit the said lands twice in every year to be used for the exhibition of stock, produce, and agricultural implements; and also twice in every year shall, without charge, permit the Southland Caledonian Society to use the said land for holding their games or gatherings thereon. Such use shall in each case be for a period of not less than seven days.

6 Rents how appropriated.

Subject to the preceding provision, it. shall be lawful for the said Trustees to lease the said lands, or any part thereof, for any term not exceeding twenty-one years, and all rents, issues, and profits received from the letting of the said lands by the said Trustees shall be expended in improving the said lands, in providing proper accommodation for, and in granting premiums for, and otherwise encouraging the exhibition of stock, produce, and agricultural implements; and it shall not be lawful for the Trustees to sell or mortgage any of the said lands.

All those parcels of land in the Provincial District of Otago, situate in the Town of Invercargill, being Sections numbered respectively five (5), six (6), seven (7), eight (8), nine (9), ten (10), eleven (11), twelve (12), fifteen (15), sixteen (16), seventeen (17), eighteen (18), twenty (20), and twenty-one (21), of Block forty-five (XLV.), as shown on the record map of the said Town of Invercargill.
