An Act to provide for the Management of a Public Domain for the Borough of Lyttelton.
Preamble.
WHEREAS certain lands within the Provincial District of Canterbury, more particularly described in the Schedule to this Act, were by deed bearing date the second day of July, one thousand eight hundred and seventy-five, vested in William Bolleston, then Superintendent of the Province of Canterbury, in trust for the public use of the said province: And whereas the said lands have been fenced and planted for the purposes of a public garden and domain for the Borough of Lyttelton, and whereas it is expedient that the said lands should be brought under the provisions of “The Public Domains Act,. I860,”
and “The Public Domains Act Amendment Act, 1865”
.
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Lyttelton Public Domain Act, 1877.”
2 Management of land in Schedule hereto.
The parcels of land respectively specified and described in the Schedule hereto are hereby declared to be Crown lands, subject to the provisions of “The Public Domains Act, 1860,”
as amended by “The Public Domains Act Amendment Act, 1865,”
and shall be managed, administered, and dealt with by the Governor, as directed by the said Acts, in the same manner and to all intents and purposes as if the said parcels of land had been included and specified in the Schedule to “The Public Domains Act, 1860,”
and therein declared to be Crown lands, subject to the provisions thereof.
Schedule
I
All that parcel of land comprising four (4) acres two (2) roods and thirty-seven (37) perches, more or less, being part of Rural Section No. 375, as conveyed by deed dated 2nd July, 1875, Thomas Hodsson Parkinson to William Rolleston, as Superintendent of the Province of Canterbury; commencing at a point on the north-eastern side of the road reserved along high watermark, the said point being distant south-easterly about five hundred and forty (540) links from the south-eastern corner of Section No. 1857, and bearing therefrom 135° 15’ (mag.); thence north-easterly by a line bearing 61° (mag.) one hundred and seventy-five (175) links to the road running through the aforesaid Section No. 375; thence south-westerly along that road one hundred and six (106) links and four hundred and seventy-five (475) links; thence south-easterly along that road one hundred and forty-two (142) links and one hundred and eighty (180) links; thence north-easterly along that road one hundred and fifty-one (151) links and seven hundred and eight (708) links; thence south-easterly along that road one hundred and thirty-six (136) links, seventy-four (74) links, ninety-eight (98) links, and one hundred and sixty-six (166) links; thence south-easterly along the same road to the aforesaid road reserved along high watermark; and from thence returning southwesterly and north-westerly along that road to the commencing point.
II
All that parcel of land comprising three (3) roods and thirty-one (31) perches, more or less, being part of Rural Sections Nos. 375 and 714, as conveyed by deed dated 2nd July, 1875, Thomas Hodsson Parkinson to William Rolleston, as Superintendent of the Province of Canterbury; commencing at a point on the north-western side of the road reserved along high watermark, the said point being the southernmost corner of Section No. 714; thence south-westerly along that road to the road running through the said sections; thence north-easterly along that road five hundred and eighty-three (583) links; thence north-westerly along that road one hundred and ninety-five (195) links and eighty-two (82) links; thence north-easterly along that road one hundred and two (102) links, one hundred and sixty-one (161) links, and one hundred and ninety (190) links; thence south-easterly along the same road to the aforesaid road reserved along high watermark; and from thence returning south-westerly along that road to the commencing point.
III
All that parcel of land comprising twenty-nine (29) perches, more or less, being part of Rural Section No. 714, as conveyed by deed dated 2nd July, 1875, Thomas Hodsson Parkinson to William Rolleston, as Superintendent of the Province of Canterbury; commencing at a point on the northern side of the road reserved along high watermark, the said point being the south-eastern corner of the said section; thence north-westerly by a line bearing 125° 30’ (mag.) ninety-four (94) links; thence south-westerly along the road running through the said section to the aforesaid road reserved along high watermark; and from thence returning north-easterly along that road to the commencing point.
