An Act to vest a certain Reserve in Mataura, in the Provincial District of Otago, in Trustees on trust for Recreation and other Purposes.

Preamble.

WHEREAS the lands described in the Schedules to this Act were, by grant from the Crown dated the thirty-first day of January, one thousand eight hundred and seventy, with other lands, reserved and granted to the then Superintendent of the then Province of Southland for purposes connected with the ferry across the Mataura River and as a site for an accommodation-house: And whereas the lands described in the Schedules to this Act are not now required for such purposes: And whereas it is expedient to set aside the said land for recreation purposes and for agricultural and pastoral association purposes as hereinafter provided:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Mataura Reserve Act, 1877.”

2 Lands vested for recreation purposes.

The land described in the First Schedule to this Act shall be and the same is hereby absolutely vested in and transferred to the Trustees hereinafter named in trust for recreation purposes for the inhabitants of the Mataura Township and surrounding district.

3 Lands vested for agricultural and pastoral association purposes.

The land described in the Second Schedule to this Act shall be and the same is hereby vested in and transferred to the Trustees hereinafter named in trust for the Mataura Pastoral and Agricultural Society, and for the purposes for which such Society was formed.

4 Trustees named and incorporated.

The Trustees for the said lands shall be Thomas MacGibbon, merchant, Mataura; Hugh Cameron, Mataura; John Beatie, Mataura; James Pollock, Mataura; James Stewart Shanks, Mataura; and the said Trustees, by the name of “The Mataura Reserve Trust,” shall be a body corporate, and may do and suffer all things that bodies corporate may do and suffer.

5 Trust to manage lands. Proviso

The Mataura Reserve Trust shall manage the said lands in all respects as to the said Mataura Reserve Trust may seem expedient, but so that the lands shall be used for the purposes for which they have by this Act been set apart; and any rents or revenue the said Mataura Reserve Trust shall receive shall be expended on the said lands: Provided always that the Trustees may for seven days in a year close the recreation reserve to the public, and charge for admission to such reserve· on such days.

6 Members of Trust may become disqualified, and Governor may appoint other members.

If any of the members of the said Mataura Reserve Trust shall die, or shall become bankrupt, or take the advantage of any law for the relief of insolvent debtors, or be convicted of any felony, or be absent from the Provincial District of Otago for nine months, then in any of the said cases such member shall cease to be a member of the Mataura Reserve Trust; and the Governor may in any such case, or in case any member resigns his membership, appoint another or others in his place.

SCHEDULES

FIRST SCHEDULE Reserve for Recreation Purposes, Town of Mataura

All that parcel of land in the Provincial District of Otago, containing by admeasurement five (5) acres, more or less, being part of Section numbered one a (1a) on the Crown grant record map of the Lyndhurst Survey District, and Crown-granted to the Superintendent of the Province of Southland on the thirty-first day of January, 1870, by Crown grant No. 2169. Bounded towards the North-east by a line commencing at the northwestern corner of the said section, and running easterly along the boundary of the said section, five hundred and ninety-three (593) links; thence towards the South-east by a line, eight hundred and forty (840) links; thence towards the South-west by a road line, five hundred and ninety-three (593) links; and thence towards the North-west by a line being the western boundary of the said section, eight hundred and forty (840) links, to the starting point: be all the aforesaid linkages more or less.

SECOND SCHEDULE Reserve for Agricultural and Pastoral Association Purposes, Town of Mataura

All that parcel of land in the Provincial District of Otago, containing by admeasurement five (5) acres, more or less, being part of Section numbered one a (1a) on the Crown grant record map of the Lyndhurst Survey District, and Crown-granted to the Superintendent of the Province of Southland on the thirty-first day of January, 1870, by Crown grant No. 2169. Bounded towards the North-east by a line commencing at the eastern corner of the Recreation Reserve, described in the First Schedule, and running easterly along the boundary of the said section, six hundred and thirty-two (632) links; thence towards the South-east by a line, eight hundred and forty-five (845) links; thence towards the South-west by a road line, five hundred and sixty-two (562) links; and thence towards the North-west by a line, eight hundred and forty (840), links to the starting point: be all the aforesaid linkages more or less.
