An Act to make Provision for the Division of the Okarito Road District into two Road Districts.
Preamble.
WHEREAS the Okarito Road District is at present constituted under “The County of Westland Act, 1868”
(hereinafter called “the said Act”
), and it is expedient that the said district should be divided into two road districts:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Jackson’s Bay Road District Act, 1877.”
2 Governor may constitute “Jackson’s Bay Road District.”
It shall be lawful for the Governor, after the expiration of two months from the time of the presentation of the petition hereinafter mentioned, by Proclamation to be published in the New Zealand Gazette, to divide the Okarito Road District mentioned in the Third Schedule to the said Act, and to constitute a portion of the said district into a new road district under the name of “The Jackson’s Bay Road District,”
subject to the following terms and conditions:—
(1.)
That a petition is presented to him signed by not less than three-fourths of the electors entitled to vote for members of the Road Board for such new district, setting forth the boundaries of such district.
(2.)
That such petition is publicly notified by advertisement in some newspaper usually circulating in the Okarito Road Board District not less than one month before presentation to the Governor.
(3.)
And that no petition from an equal or greater number of such electors is presented to the Governor within two months after such public notification, praying the Governor not to assent to the prayer of the first petition.
3 When new district constituted, “The County of Westland Act, 1868,”
to apply thereto.
Whenever such new district is constituted, all the provisions of the said Act shall be applicable to such new road district as if such district had been originally constituted under the said Act, except so far as such provisions may be modified or altered by this Act.
4 First election of members of Road Board.
The first election of members of the Road Board of the new road district hereby constituted shall be held on such day as the Governor shall direct, and such election shall be conducted in like manner in all respects, so far as applicable, as an election to fill an extraordinary vacancy occurring under the said Act.
5 Governor may appoint person to apportion assets and liabilities in case of dispute.
In case the Road Board of the Okarito Road District shall be unable to agree with the Road Board of the Jackson’s Bay Road District as to the apportionment of the assets and liabilities of the Okarito Road District existing at the time of the coming into operation of this Act, the Governor may, on the application of the Road Board of either of such districts, appoint some person to determine and adjust the same, and the decision of the person so appointed shall be final and conclusive on the Road Boards of both the said road districts.
