An Act to enable the Governor to exchange certain Hospital Endowment Reserves in the Upper Waikato District for other Lands in the same District.
Preamble.
WHEREAS the Honorable James Williamson, of Auckland, freeholder, has proposed to convey to Her Majesty the lands described in the First Schedule hereto, in equivalent exchange for the lands described in the Second Schedule hereto, which, on the thirteenth day of July, in the year one thousand eight hundred and sixty-eight, were excepted from sale and reserved to Her Majesty, her heirs and successors, for the purposes of an endowment for hospital for sick: And whereas the Land Board of the Land District of Auckland has recommended that the aforesaid proposal should be carried into effect: And whereas the above-named reserves have not heretofore been granted by the Crown:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Waikato Hospital Reserves Exchange Act, 1877.”
2 Governor may effect an exchange of lands in Schedules.
Upon the due execution of a deed of conveyance to Her Majesty by the above-named James Williamson of the lands described in the First Schedule hereto, it shall be lawful for the Governor to issue a Crown grant to the said James Williamson aforesaid of the lands described in the Second Schedule hereto, absolutely freed from and discharged of any trust upon which the last-mentioned lands may have been set apart or reserved as aforesaid: Provided that all costs and charges incident to the further assurance to Her Majesty of the lands described in the First Schedule hereto shall be borne by James Williamson aforesaid.
3 Lands acquired by Her Majesty to be reserved as hospital endowments.
The lands described in the First Schedule hereto, when the same shall be conveyed to Her Majesty, shall be deemed to be reserved to Her Majesty, her heirs and successors, as an endowment for hospital for sick, in the same manner as the lands described in the Second Schedule hereto have been heretofore reserved.
SCHEDULES
FIRST SCHEDULE
ALL those parcels of land containing two hundred and fifty (250) acres, more or less, in the Upper Waikato District, within the Provincial District of Auckland, being Allotments Nos. one hundred and sixty-one (161), one hundred and sixty-four (164), one hundred and sixty-five (165), and one hundred and sixty-eight (168), all in the Parish of Tuhikaramea; and also Lot No. twenty-two (22), in the Parish of Kirikiriroa.
SECOND SCHEDULE
ALL those parcels of land containing one hundred (100) acres, more or less, in the Upper Waikato District, within the Provincial District of Auckland, being Allotments Nos. three hundred and sixteen (316) and three hundred and seventeen (317), in the Parish of Hautapu, as the same are respectively shown in the official maps or plans in the Survey Office in Auckland.
