An Act to vest certain Public Reserves in the Borough Council of New Plymouth.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Borough of New Plymouth Reserves Act, 1877.”
2 Lands vested in Mayor, Councillors, and Burgesses of Borough of New Plymouth.
From and after the passing of this Act the lands described in the First Schedule hereto shall be vested without any conveyance or assurance in the Mayor, Councillors, and Burgesses of the Borough of New Plymouth.
3 Council may lease lands.
The Council shall have power to manage and lease the said lands under the provisions of “The Municipal Corporations Act, 1876,”
for the purposes mentioned in the said First Schedule, and the rents or profits arising therefrom shall be deemed to be borough funds.
4 Power to construct reservoir.
The Council shall have power to construct a reservoir on the land described in the Second Schedule, for the supply of water to the inhabitants of the said borough; and for this purpose the Council may enter on the said land and construct such works as may be necessary to complete the said reservoir: Provided before the works are commenced the site for such reservoir be approved of by the Governor in Council.
SCHEDULES
FIRST SCHEDULE
All that parcel of land situate in the Town of New Plymouth, containing by admeasurement three (3) acres two (2) roods seven (7) perches, more or less, being a Military Reserve, and Allotments Nos. 1612, 1613, 1614, and 1615 on the plan of the said town. Bounded towards the North by Lemon Street, five hundred and three (503) links; towards the East by Hobson Street, seven hundred and five (705) links; towards the South by Allotments Nos. 1681, 1682, 1683, and 1684, five hundred and three (503) links; and towards the West by Allotments Nos. 1658, 1630, and 1611, seven hundred and five (705) links. To be held for purposes of public utility.
SECOND SCHEDULE Part of Marsland Hill
All that parcel of land situate in the Town of New Plymouth, containing by admeasurement twelve (12) acres, more or less, being part of the Marsland Hill Military Reserve. Bounded towards the North by a line in continuation of the south side of Bulteel Street, six hundred and forty-two (642) links; towards the East by Allotments Nos. 790 and 802, four hundred and ten (410) links; again towards the North by Allotment No. 802 and Brougham Street, two hundred and ten (210) links; again towards the East and South by the Huatoki Stream; towards the North-west and West by other part of the said reserve five hundred and twenty (520) links and four hundred (400) inks, the east side of Robe Street one hundred (100) links, a burial-ground one hundred and eighty-three (183) links, seventy (70) links, two hundred and forty (240) links, twenty-five (25) links, forty-five (45) links, and two hundred and fifteen (215) links, and Robe Street two hundred and twenty-three (223) links.
