An Act to empower the School Commissioners for the Otago Provincial District to transfer or otherwise deal with certain Portions of Land vested in the said Commissioners for the purposes of the Kakanui Road Board and the Oamaru Waterworks.

Preamble.

WHEREAS it is expedient to enable the School Commissioners of the Otago Provincial District to deal with the lands described in the Schedules hereto in the manner hereinafter set forth:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Otago School Commissioners Empowering Act, 1878.”

2 Power for the Otago Education Commissioners to convey or transfer to the Kaka- nui Road Board a portion of the land described in Schedule A.

It shall be lawful for the Otago School Commissioners to convey or transfer to Her Majesty the Queen, on such terms and conditions as the said Commissioners may think fit, for the purposes of a road to be formed as shown on the survey plans in continuation of the existing road line in Tyne Street, Oamaru, to a reserve known as “The Cape Bush Reserve,” such portion of the land described in Schedule A to this Act as may be required by the said Road Board for the purposes of the said road.

3 Power for the Commissioners to convey or lease a portion of the land described in Schedule B, or to grant power to tunnel through the same.

It shall be lawful for the Commissioners to convey or lease, for such term exceeding twenty-one years, and on such terms and conditions, as the said Commissioners may think fit, to the Corporation of the incorporated Town of Oamaru, for the purpose of the construction of the Oamaru Waterworks, such portion of the land described in Schedule B to this Act, or to grant to the said Corporation power and license to construct tunnels or tunnelling works in, under, or through such last-mentioned land, as may be necessary or requisite for the purpose of the said waterworks.

4 Power for the Commissioners to sign contracts, transfers, conveyances, &c.

It shall be lawful for the Otago School Commissioners, for any of the purposes contemplated by this Act, to enter into, sign, and execute such contracts, transfers, conveyances, and other deeds and assurances as may be found necessary.

Allotment numbered one (1) of Section numbered fifty-seven (57), Block four (IV.), on the record map of the Oamaru Survey District.

Schedule B

Sections numbered respectively thirty-two (32) and thirty-three (33), and Allotment numbered one (1) of Section numbered thirty-four (34) of Block thirteen (XIII.), on the record map of the Oamaru Survey District.
