An Act to amend “The Lyttelton Harbour Board Act, 1876.”
Preamble.
WHEREAS by the forty-third section, of “The Lyttelton Harbour Board Act, 1876”
(hereinafter called “the said Act”
), the Lyttelton Harbour Board was authorized to borrow and raise any sum or sums of money not exceeding in the whole one hundred thousand pounds for the purposes therein mentioned: And whereas the said power has not been exercised, and it is expedient that further provision should be made enabling the said Board to borrow money for the purposes of the said Act:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Lyttelton Harbour Board Act Amendment Act, 1878.”
2 Power to Lyttelton Harbour Board to borrow a sum not exceeding £200,000.
So much of the forty-third section of the said Act as enables the Lyttelton Harbour Board to borrow and raise any sum or sums of money not exceeding one hundred thousand pounds is hereby repealed, and in lieu thereof the said Board is hereby empowered to borrow and raise, in the manner, on the terms, and subject to the conditions prescribed by the said Act, any sum or sums of money not exceeding in the whole two hundred thousand pounds; and all such moneys shall be applied to the purposes mentioned in the said forty-third section: Provided that no claim of any holder of debentures under this Act shall attach to or be paid out of the public revenues of New Zealand or by the General Government thereof.
3 If Act passed prescribing terms of borrowing, &c., this session, moneys shall be raised in accordance.
Notwithstanding anything hereinbefore contained, if any Act shall be passed by the General Assembly in the present session prescribing the terms, manner, and conditions upon and subject to which Harbour Boards may borrow money, then the moneys hereby authorized to be borrowed shall be borrowed and raised only in accordance with the provisions of such Act.
4 Board shall have certain powers of “Public Works Act, 1876.”
The Lyttelton Harbour Board shall, for harbour purposes and for purposes of harbour works, with respect to the streets and roads described in the Schedule, have all the powers of taking roads, streets, and lands which a Road Board has under “The Public Works Act, 1876,”
or any Act amending the same, of taking lands for public works.
Schedule
All that portion of Godley Quay and of the Beach Road commencing at the southeast corner of Town Section No. 234, and extending along that quay and road to the south-east corner of that portion of Rural Section No. 714 occupied as domain and recreation reserve; also the cross street leading from Godley Quay to Brittan Terrace.
